A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD APPROVING AND ADOPTING A NEGATIVE
DECLARATION FOR THE ACQUISITION OF SITE FOR
AND CONSTRUCTION OF A STORM WATER DETENTION
BASIN AT THE NORTHEAST CORNER OF FAIRFAX ROAD
AND COLLEGE AVENUE.
WHEREAS, the Development Services Department of the City
of Bakersfield prepared a Negative Declaration for the acquisition
and construction of a storm water detention basin; and
WHEREAS, said Negative Declaration was prepared in
accordance with City of Bakersfield Resolution No. 60-80; and
WHEREAS, notice of preparation of said Negative
Declaration was given by posting and publication as required by
law; and
WHERAS, a public hearing on said Negative Declaration
was duly held and conducted by the Bakersfield City Council at a
regular meeting thereof on November 18, 1981; and
WHEREAS, all comments which have been received during
the review period on said Negative Declaration and the responses
thereto, together with the proposed Negative Declaration and initial
study documenting reasons to support the finding that the project
will not have a substantial adverse effect upon the envirorment,
have been forwarded to the City Council, and this Council has
reviewed, considered and evaluated the contents thereof.
NOW, THEREFORE, the Council of the City of Bakersfield
hereby resolves, finds and determines as follows:
1. That the above recitals are true and correct.
2. That the City Council has read, evaluated and con-
sidered the Negative Declaration, together with all applicable
supporting documents.
3. That the project designated as the acquisition of
site for and construction of a storm water detention basin at the
northeast corner of Fairfax Road and College Avenue, Bakersfield,
will not have a significant adverse effect on the enviror~nent.
4. That the Negative Declaration on the said project
is hereby approved and adopted.
5. That the project is approved.
6. That the Development Services Department shall file
with the Kern County Clerk a Notice of Determination as required
by the State EIR Guidelines and City of Bakersfield Resolution
No. 60-80.
7. That certified copies of this resolution shall be
transmitted to such agencies as may be designated by the Development
Services Department of the City of Bakersfield.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on the 18th day of November, 1981, by
the following vote:
