HomeMy WebLinkAboutRES NO 80-81RESOLUTION NO. 80--81 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD ORDERING THE VACATION OF A PORTION OF OAK STREET AT TRUXTUN AVENUE, IN THE CITY OF BAKERSFIELD. WHEREAS, on the 23d day of September, 1981, the Council of the City of Bakersfield, pursuant to the provisions of the "Street Vacation Act of 1941," being Division 9, Part 3, of the Streets and Highways Code of the State of California, passed and adopted its Resolution of Intention No. 951 declaring its intention to order the vacation of a portion of Oak Street at Truxtun Avenue, in the City of Bakersfield, County of Kern, State of California; and WHEREAS, this Council did fix a time and place for hearing all persons interested in or objecting to said proposed vacation, which said hearing was held on the 14th day of October, 1981, after notices were duly posted as required by law; and WHEREAS, this Council has received and accepted this date a deed dedicating property adjacent to Truxtun Avenue for street purposes, which, together with the vacation made hereby, facilitates reconstruction of the Oak Street - Truxtun Avenue intersection. NOW, THEREFORE, BE IT FOUND AND RESOLVED by this Council as follows: 1. That a portion of Oak Street at Truxtun Avenue, in the City of Bakersfield, County of Kern, State of California, more particularly described in Exhibit "A" attached hereto and made a part hereof, is unnecessary for present or prospective public street purposes. 2. That a portion of Oak Street at Truxtun Avenue, be and the same is hereby closed up, vacated and abandoned for public street purposes, subject to and in conformity with the reservations and exceptions contained in and contemplated by said Resolution of Intention No. 951. Reference to said Resolution of Intention is hereby made for further particulars. 3. ON OF OAK ST21iET " All that portion of Oak Street.in the City of Bakersfield conveyed to the Stat~ of California by Deed recorded June 3, 1939 in Book 872, at page 62 of Official Records in 'the Office of the Kern County Recorder, more particularly described as follows: Commencing at the intersection of the north right-of-way line of Truxtun Avenue with the west right-of-way line of that 20 foot alley on the west boundary of Tract 1243 as said Tract is shown upon a map recorded January 4, 1945 in Map Book S1 a.t page 86 in the Office of the Kern County Recorder; THENCE North 89° 10' 00" West along the last named 'north right-of-way line a distance of 81.50 feet to a point on a tangent curve concave to the northeast having a radius of 25 feet; THENCE northwesterly along the last named curve through a cent'ral angle of 59~ 43' 33" an arc length of 26.06 feet to a point from which the radial center bears North 60~ 33' 33" East, said point also ~eing the True Point of Beginning for this description; THENCE'continuing along the last named~curve through a central angle 26~ 34' 32" an arc l~ngt~ of 11.60 feet to a point on the easterly right-of-way line of Oak Street; THENCE North 02~ Sl' 55" West along the last named zight-of-way line a distance of 86.09 ,feet; THENCE South 00° 49' S5" East a distance of 77.77 feet to a point on a tangent curv~ concave to the northeast having a radius of 25 feet; THENCE Southeasterly along the last named curve through a central angle of 49~ 56' 20" an arc length of 21.79 feet to the POINT OF BEGINNING.
