A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD ESTABLISHING A RECORDS-RETENTION
SCHEDULE FOR THE POLICE DEPARTMENT AND APPROVING
DESTRUCTION OF RECORDS IN ACCORDANCE THEREWITH.
WHEREAS, except for records affecting the title to real
property or liens thereon, court records, records required to be
kept by statute, records less than two (2) years old and the
minutes, ordinances, resolutions of the legislative body of the
Council and other boards or commissions, Government Code section
34090 authorizes the head of a city department to destroy any
city record, document, instrument, book or paper, under his
charge, without making a copy thereof, after the same is no
longer required, with the approval of the legislative body by
resolution and the written consent of the City Attorney; and
WHEREAS, the Council, upon request of the Chief of
Police, desires to establish a retention schedule for records
under the charge of the police department and to approve immediate
destruction of records in accordance therewith and the continued
destruction of the listed items in accordance with such retention
schedule.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Bakersfield that the following retention schedule for
records, documents, instruments, books or papers under the charge
of the police department is hereby adopted, and pursuant to
Section 34090 et seq. of the Government Code of the State of
California, approval is hereby granted for the immediate destruction
of the items listed which have been retained for the required
period of time and for the continued destruction of such listed
items in accordance with such retention schedule:
I. All records, documents, instruments, books and papers
which are two (2) years old,

Retain three (3) years:
Dispatch cards with case numbers.
Property cards.
Misdemeanor crime reports.
Card room permits.
Rejected job applications.
Retain four (4) years:
Bicycle registrations.
Case log book.
Duty Roster.
Personnel eligibility list.
Retain five (5) years:
Fatal and injury traffic accidents.
Felony crime reports.
Sex offenses involving children.
Sex perversion.
Chief's memorandums.
Vice investigations.
Narcotics investigations.
Non-sustained complaints against department
personnel.
Retain until case is closed and destroy when report is
five (5) years old:
1. Reports involving theft of guns.
Retain until case is closed and destroy when report is
two (2) years old:
Reports that have expired under statute of
limitations.
Retain indefinitely:

Homicide.
Personnel records.
General and special orders.
Assault on police officers.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on the 9th 'day of September, 1981, by
the following vote:

Pursuant to Government Code section 34090 et seq., the
records, documents, instruments, books and papers of the Bakersfield
Police Department which are two (2) years old shall be destroyed,
except as follows:
A. Retain three (3) years:
Dispatch cards with case numbers.
Property cards.
Misdemeanor crime reports.
Card room permits.

B. Retain four (4) years:
