A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AUTHORIZING THE FILING OF AN
APPLICATION WITH THE KERN COUNTY COUNCIL
OF GOVERNMENTS FOR CLAIM OF TRANSPORTATION
DEVELOPMENT ACT FUNDS FOR EXCLUSIVE USE OF
PEDESTRIANS AND BICYCLES.
WHEREAS, The Transporation Development Act of 1971 provides
for the disbursement of funds from the Local Transporation Fund held
in trust by the Kern County Auditor-Controller for use by eligible
claimants for the purpose authorized by Article 3, Section 99233.3;
and
WHEREAS, an eligible claimant wishing to claim such Local
Transportation Funds must file its application with the Kern County
Council of Governments pursuant to the rules and regulations that
have been adopted by the Secretary of the Business and Transportation
Agency of the State of California in accordance with the provisions
of the aforementioned legislation; and
WHEREAS, funds from the Local Transporation fund will be
used to construct and maintain facilities for the exclusive use of
pedestrians and bicycles to be located along the Kern River between
Cal State Bakersfield and Hart Park and also to Bakersfield College.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Bakersfield as follows:
1. That the Director of Public Works is authorized to
execute and file an appropriate claim pursuant to the terms of the
Transportation Development Act of 1971, as amended, and pursuant
to applicable rules and regulations promulgated thereunder, together
with all necessary supporting documents, with the Kern County
Council of Governments for Fiscal Year 1981-82 Transportation
Development Act monies.
2. That a copy of this resolution be transmitted to the
Kern County Council of Governments in conjunction with the filing
of the claim; and the Kern County Council of Governments be requested
to concur in these findings and grant funds as specified on the
Article 3 claim.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at
a regular meeting thereof held on the 29th day of July, 1981,
by the following vote:
