HomeMy WebLinkAboutRES NO 46-81RESOLUTION NO. 4~-R1 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD REQUESTING A VOLUNTARY RECOGNITION OF NON-SMOKERS' RIGHTS. WHEREAS, some residents of the City of Bakersfiel'd find tobacco smoke to be offensive; and WHEREAS, medical evidence indicates that tobacco smoke can endanger the health of non-smokers; and WHEREAS, the City Council believes that the rights of non-smokers can best be protected by voluntary recognition of the rights of non-smokers. NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Bakersfield encourages voluntary compliance with the following guidelines: 1. Smoking be prohibited in the following places: a. Elevators, museums, galleries, public transporta- tion facilities open to the public, and service lines of establishments doing business with the general public. b. Public Meetings. During public meetings, except in that area of the building commonly known as the lobby. c. Health Facilities - as per existing State i aw. d. Grocery Stores - as per existing State law. e. Theaters, auditoriums, pavilions, and exposition halls open to the general public for the primary purpose of conducting or exhibiting any motion pictures, stage drama, musical, recital, lecture, athletic event, or other performance in any area other than that commonly known as the lobby while such theater, auditorium, pavilion or exposition hall is actually being used for the purpose delineated herein and actually open to the public. ...... f. Witkin retail stores doing business ~i~h the general public, except areas in said stores devoted exclusively to the sale of tobacco products, areas in said stores not open to the public, and all areas within retail tobacco shops. g. In all public restrooms. 2. All managers and owners of any establishment serving or doing business with the public are encouraged to post "No Smoking" signs within various areas of their business. 3. Non-smoking sections be established as follows: a. Eating Establishments: Non-smoking sections should be established of not less than 30% of the entire seating capacity within every public or privately-owned coffee shop, soda fountain, or other eating establishments serving food to the general public whose occupied capacitlT is 50 or more persons. (1) A non-smoking section of not less than 30% of the entire seating capacity should be provided in privately-owned establishments and cafeterias, where 30% or more of the employees request a non-smoking section. '2) Bars and Cocktail Lounges which do not serve \ food would be subject to the discretion of the owner- manager, as to whether or not a non-smoking section would be established. (3) This recommendation does not apply to banquet.rooms in use for private functions. (4) Department Heads of the various departments of the' City of Bakersfield should discourage employees from smoking in work areas and furthermore should request that employees desiring to smoke, do so only while on authorized breaks outside of City Hall~ BE IT FURTHER RESOLVED by the City Council of the City of Bakersfield that this voluntary program will be annually reviewed by the City.
