A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD MAKING FINDINGS AND APPROVING
SEGMENT I OF PROPOSED AMENDMENT TO THE LAND
USE ELEMENT OF THE BAKERSFIELD METROPOLITAN
AREA GENERAL PLAN (LAND USE AMENDMENT 1-81).
WHEREAS, the Council of the City of Bakersfield referred
Segment I of a proposed amendment to the Land Use Element of the
Bakersfield Metropolitan Area General Plan to the Planning Commis-
sion; and
WHEREAS, the Planning Commission of the City of Bakersfield,
in accordance with the provisions of Section 65351 of the Government
Code, held a continued public hearing on May 7, 1981, on Segment
I of a proposed amendment to the Land Use Element of the General
Plan, notice of the time and place of hearing having been given
at least ten (10) days before said hearing by publication in a
local newspaper of general circulation; and
WHEREAS, such Segment I of the proposed amendment to
the Land Use Element of the Bakersfield Metropolitan Area General
Plan concerns the following area:
SEGMENT 1:
TIM GANNON and JAMES WATTENBARGER have ap-
plied to change the land use designation on
18.86 acres located South of the Kern River
on the West side of Manor Street, the North
side of the Kern Island Canal and the East
side of the South Side Canal from Open Space
(11.4 acres) and Medium Density Residential
(7.46 acres) to Low Density Residential.
WHEREAS, for the above-described Segment, the Planning
Commission on May 7, 1981, by Resolution No. 20-81, made findings,
including mitigation of significant environmental effects, and
recommended certification by the City Council of completion of
the Final Environmental Impact Report; and
WHEREAS, this Council, by resolution adopted June 17,
1981, made certain findings, and certified as complete, the Final
Environmental Impact Report for this Segment; and
WHEREAS, the law and regulations relating to the prepara-
tion and completion of Environmental Impact Reports as set forth
in CEQA, the State Environmental Impact Report Guidelines and
City of Bakersfield Resolution No. 60-80 have been duly followed
by the City staff and Planning Commission; and
WHEREAS, by Resolution No. 22-81 on May 7, 1981, the
Planning Commission approved and recommended adoption by the City
Council of the above-described Segment I, with the condition set
forth hereinbelow; and
WHEREAS, the Council of the City of Bakersfield, in
accordance with the provisions of Section 65355 of the Government.
Code, conducted and held a public hearing on June 24, 1981, on
the above-described Segment I of the proposed amendment to the
Land Use Element of the Bakersfield Metropolitan Area General
Plan, notice of time and place of the hearing having been given
at least ten (10) calendar days before the hearing by publication
in the Bakersfield Californian, a local newspaper of general
circulation.
NOW, THEREFORE, IT IS HEREBY FOUND AND RESOLVED AS
FOLLOWS:
and correct.

The above recitals, incorporated herein, are true
The report of the Planning Commission, including
maps and all papers relevant thereto, transmitted by the Secretary
of the Planning Commission to the City Council, is hereby approved.
3. That the City Council hereby approves and adopts
Segment I of the proposed amendment to the Land Use Element
constituting a change from Open Space on 11.4 acres and Medium
Density Residential on approximately 7.46 acres to Low Density
Residential, as shown on map, subject to the condition that
development be limited to a total of 60 dwelling units on the
18.86 acres.
4. That Segment I of proposed amendment to the Land
Use Element be combined with other segments described in separate
resolutions to form a single Land Use Element Amendment, 1-81.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on the 24th day of June, 1981, by the
following vote:
