A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD URGING THE STATE LEGISLATURE
TO ADOPT ASSEMBLY BILL 1856.
WHEREAS, the flood waters inundating the Bakersfield
area in February and March, 1978, required that the City take
rapid emergency measures to protect-'its residents; and
WHEREAS, the City of Bakersfield was eligible for a
Federal Disaster Assistance Categorical Grant of $35,705 and a
Flexible Funding Grant of $56,159 for the emergency work; and
WHEREAS, the City of Bakersfield has not been able to
recover this money because of a provision in CalifOrnia law requir-
ing that the contractor doing the work for the City must have
posted a payment bond; and
WHEREAS, under the emergency circumstances it was not
feasible or possible to post a payment bond due to the need for
immediate action; and
WHEREAS, the provision in California law (Civil Code
sections 3247-3258) created an undue financial burden on the City
of Bakersfield; and
WHEREAS, Assembly Bill 1856, an urgency measure of the
Assembly, would waive the payment bond requirements of California
law for disaster damage during the period of the flood water
inundation; and
WHEREAS, the City of Bakersfield will recover approxi-
mately $65,000 upon passage of Assembly Bill 1856~. '
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Bakersfield as follows:
The City of Bakersfield urges all California legislatures
to support Assembly Bill 1856 so that the City of Bakersfield
and other similarly situated local entities, may recover costs
incurred as a result of emergency action taken to protect residents.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on the 22d day of April, 1981,. by the
