A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD MAKING FINDINGS, ADOPTING A
NEGATIVE DECLARATION ON SEGMENT III, AND
APPROVING SEGMENTS I, III, AND IV OF PRO-
POSED AMENDMENT TO THE LAND USE ELEMENT OF
THE BAKERSFIELD METROPOLITAN AREA GENERAL
PLAN.
WHEREAS, the Council of the City of Bakersfield referred a
proposed amendment to the Land Use Element of the Bakersfield
Metropolitan Area General Plan, consisting of Segments I and IV,
to the Planning Commission; and
WHEREAS, pursuant to recommendations of the Planning Director,
the Planning Commission has considered, as a portion of such
amendment, Segment III thereof; and
WHEREAS, the Planning Commission of the City of Bakersfield,
in accordance with the provisions of Section 65351 of the Government
Code, held a public hearing on December 17, 1980, and continuing
on January 7, 1981 on a proposed amendment to the Land Use Element
of the General Plan, notice of and place of the hearing having
been given at least ten (10) calendar days before said hearing by
publication in the Bakersfield Californian, a local newspaper of
general circulation; and
WHEREAS, such proposed amendment to the Land Use Element of
the Bakersfield Metropolitan Area General Plan concerns the follow-~~
ing areas:
SEGMENT I:
The CITY OF BAKERSFIELD has applied to change the Low Density
Residential designation for approximately 321 acres described
in general terms, below, with the proposed land use designations:

SEGMENT III:
The CITY OF BAKERSFIELD has applied to change several desig-
nations in order to conform to existing land use and/or zoning.
The following conformance changes apply to nearly 390 acres lo-
cated in Southwest Bakersfield.

'SEGMENT IV:
PORTFOLIO PROPERTIES has applied to change the Low Density
Residential designation to Commercial for 18+ acres, and to
Industrial for 150'+ acres located North and E'ast of the
Arvin-Edison Canal,'South of the Southern Pacific Railroad
and West of Stine Road coincident with the proposed Panama
Lane No. 3 Annexation request (520 acres)·
WHEREAS, for Segment I as described above, the Planning Com-
· mission on January 7, 1981 made findings and recommended certifi-
cation by the City Council of completion of the Final Environmental
Impact Report, for the Bakersfield Airpark Land Use Plan; and
WHEREAS, for Segment III, described above, an Initial Study was
conducted and it was determined that the proposed project could not
have a significant effect on the environment and a Negative Declaration
was prepared; and
WHEREAS, for Segment IV, as described above, the Planning Com-
mission on January 7, 1981 made findings and recommended certifica-
tion by the City Council of completion of the Final Environmental
Impact Report for proposed Land Use Element Amendments, described
above, and contained in Annexation No. 282., Panama Lane No. 3, Draft
Environmental Impact Report; and
WHEREAS, the law and regulations relating to the preparation
and adoption of Environmental Impact Reports and Negative Declarations
as set forth in CEQA, the State Environmental Impact Report Guide-
lines, and City of Bakersfield Resolution 60-80 ha~e~been duty
followed by the City staff and Planning Commission.
WHEREAS, as to Segments I, III, and IV, the Planning Commis-
sion, by Resolution No. 46-80 on January 7, 1981, approved and
recommended adoption by the City Council, subject to the conditions
in said Resolution as to that Segment; and
WHEREAS, the Council of the City of Bakersfiel'd, in accord-
ance with the provisions of Section 65355 of.the Government Code,
conducted and held a public hearing on March 11, 1981, on the above-
described proposed amendment to the Land Use Element of the
Bakersfield Metropolitan Area General Plan consisting of the three
segments as aforesaid, notice of time and place of the hearing having
been given at least ten (10) calendar days before the hearing by
publication in the Bakersfield Californian, a local newspaper of
general circulation.
NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED AND RESOLVED AS
FOLLOWS:
1. The above recitals incorporated herein, are true and
correct.
2. That as to Segment I, the Planning Commission on January 7,
1981 made findings with supporting statements including mitigation of
significant environmental effects and recommended.certification as
contained in Resolution 44-80 to the City Council of the Final En-
vironmental Impact Report for the Bakersfield Airpark Land Use Plan
consisting of a Draft EIR dated October 1980, an Addendum consisting
of Comments and Responses dated December 1980, and information ap-
plied to areas modified and added by the Planning Commission as con-
tained in Resolution 44-80.
3 That by Resolution No 15-81 adopted March 11, 1981, the
Council did certify that the Final EIR for the Bakersfield Airpark
Land Use Plan was completed in compliance with CEQA, the State EIR
Guidelines, and City Council Resolution No. 60-80.
4. That the Negative Declaration as to Segment III is hereby
approved and adopted.
..... ~ . That _as to Segment IV, the Planning ~Commission, on
January 7, 1981, made findings and recommended certification as con-
tained in Resolution 45-80 to the City Council of the Final Environ-
mental Impact Report dated October 1980 for the General Plan Land
Use Element portion of the Panama Lane No. 3 Annexation area.
6. That by Resolution No. t6'8~ ·adopted March 11,·!981,
the Council did certify that the Final EIR for the ·General Plan
Land Use Element portion of the Panama Lane No. 3 Annexation Area
was completed in compliance with CEQA, ~he State EIR Guidelines,
and City Council Resolution No. 60-80.
7. That as to Segment I of the proposed amendment to the
Land Use Element in the vicinity of the Bakersfield Airpark, con-
stituting a change from Low Density Residential to Industrial on
approximately 208.6 acres, from Low Density Residential to Open
Space on approximately 110.8 acres, and from Low Density Residential
to Commercial on approximately 1.7 acres, the City Council hereby
approves and adopts the amendment.
8. That as to Segment III of the proposed amendment to the
Land Use Element, constituting a change for approximately 390 acres
in Southwest Bakersfield as shown on the map, the City Council
hereby approves and adopts the amendment.~L
9. That as to Segment IV of the proposed amendment to the
Land Use Element, constituting a change from Low Density Residential
to Commercial for approximately 18 acres, and from Low Density Resi-
dential to Industrial for approximately 150 acres, located North and
East of the Arvin-Edison Canal, South of the Southern Pacific Rail-
road and West of Stine Road, coincident with the proposed Panama Lane
No. 3 Annexation request (520 acres), the City Councilhereby
approves and adopts the amendment, subject to the following conditions:
a) The proposed 4.8-acre neighborhood
shopping center should be zoned C-1
(Limited Commercial) and located
generally at the center of the total
development; however, its relation to
proposed school sites, park, and col-
lector streets within the proposed
development should be subject to the
final approval of the Planning Com-
mission and City Council.
b) Because adequate vacant land is zoned
C-2 (Commercial) in the immediate vi-
cinity of the project (Northeast corner
of Panama Lane and Stine Road) for com-
munity shopping purposes asenvisioned
for the needs of residential demands
generated from development of the Panama
Lane No. 3.Annexation, it is recommended
that the 'General Plan not be amended at
this time to show commercial at the
Northwest corner of Panama Lane and Stine
Road. If and when sufficient demand is
shown to justifya commercial designation
on said corner, the Planning Commission
will reconsider Land Use Element Amend-
ment.
That the proposed amendment to the Land Use Element, con-
sisting of the three (3) segments above described, the maps recom-
mended for adoption, and all the papers relevant thereto, constituting
the report of the Planning Commission required by Section 65356.51
of the Government Code, has been transmitted by the Secretary of
the Planning Commission to the City Council and iS hereby approved
in accordance with Section 65357 of the Governmen~'..Code.
11. That such Land Use Element amendment should b'e endorsed
by the Planning Director to show that it has been adopted by this
City Council.
12. That any and all development permits, zone changes or
other approvals for segments hereinabove described incorporate the
mitigation measures hereinabove set forth respectively for each of
them.

I HEREBY CERTIFY that the 'foregoing Resolution was
passed and adopted' by the Council of the' City of Bakersfield at a
regular meeting ther'eof held on the llth day of March, 1981, by
