WHEREAS, on the 5th day of October, 1953, the City of
Bakersfield and Ralph L. Smith, Jr., entered into an agreement
entitled "Contract and Specifications No. 30-53", pertaining
to the construction of streets, highways, alleys, curbs and
gutters, storm drains and sewers in Tract No. 1684, and
WHEREAS, said contract ~calls' for certain minimum speci-
fications for the construction of said streets, highways, alleys,
curbs and gutters, storm drains and ~sewers lying within' said
Tract, 'and
WHEREAS, upon the recommendation of the City Engineer, the
30'inch storm drain required' by the term of said contract %o be
placed in University Avenue in Said Tract, was.. eliminated and a
catchbasin of sufficient size was designed and constructed to meet
the requirements for surface drainage in said Tract, in addition
to more rigid minimum requirements for the surfacing of roadways,
resulting in an improved drainage system for said Tract.
NOW, THEREFORE, BE IT RESOLVED by the Council .of the City
of Bakersfield, as follows:
That the requirement of a 30-inch storm drain in University
Avenue, situate in Tract No.1684, as specified under Contract
and Specifications No. 30-53, be and the same is hereby waived,
and the changes recommended by the City Engineer in this regard
are hereby approved.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City 'of Bakersfield
at a regular meeting thereof held on the 5th day of April, 1954,
by the following vote:
