HomeMy WebLinkAboutRES NO 13-54mmsozu m WEEAS, Section 25643 of the Government Code of the State of California provides a procedure under which the County of Kern can exempt all property within the limits of the City of Bakersfield from county taxes levied for structural fire protection 'of areas in the County, and V~IEREAS, the City of Bakersfield has a highly efficient fire department capable of furnishing fire protection to all structures in the City of Bakersfield, and WHEREAS, it has been proposed that this Council petition the B.oard of Supervisors of the County of Kern that all property lying within the corporate limits of the City of Bakersfield, be exempted from nthe levy of county taxes for structural fire protection areas ~vithin said county during the ~iscal year 1954-1955. NOW,' TEEFORE, BE ~f RESOLVED by the Council of the City of Bakersfield, that the Mayor of said city be and he is hereby author- ized and directed to sign the above mentioned petition and cause the same to .be presented to the Board of Supervisors of the County of Kern. T, iA]t0'M of the y of BakerSfield' PETITION TO THE HONORABIE BOARD OF SUPERVISORS OF THE COUNTY OF KERN, STATE OF CALIFORNIA: Pursuant to the provisions of Section 28643 of the Government Code of the State of California, the City of Bakorsfield does hereby petition your Honorable Body that all property within the corporate limits of Said city be excepted from the levy of any and all county taxes for structural fire protection of areas in the County of Kern for the Fiscal Year 1954-1955. In support of this petition, the follo~ving information is hereby submitted~ 1. The City of Bakersfield has a modern municipal fire depart- ment, and is rated by the Natiorml Board of Fire Underwriters as a Class 3 City relative to the quality of fire protection and suppres- Ision~ this is equivalent to the highest rating attained by any city in California, regardless of size or location. Our fire department itself is g~aded as a Class 2 Department, with only twenty-eight cities in the entire United States holding equal or higher rating. There can be no question that the City of Bakersfield supplies, through its own organization and by means of taxes collected from within the City, a measure of structural fire protection ~vhich re- quires no continuing support from any other agency. 2. The County fire department has responded to alarms ~vithin __~_.~'the corporate limits of the city on only four occasions since its. organization, except for protective responses which are made by both the city and county when the exact location of a fire is unkmown but lies close to the boundary line of the city. On none of the four ~'~occasions in this. period of over fourteen years has the city fire department requested such assistance. 3. During this fourteen-year period, the city fire department has responded on eighteen (18) occasions to supross fire in publicly owned structures lying outside the city, which included fires in P~ad district yards, elementary schools, East Bakersfield High School, and Kern General Hospital. In fact, by agreement between all interest- ed parties, the city fire department has accepted chief responsibility for the ~'onduct of fire fighting operatings at the Kern General H~sp- 4. A~ conceivable benefit derived by the City of Bakersfield through ~the ability of the County Fire Department to combat structural ft~e~, is highly theoretical. Such a situation is extremely unlikely due to the type Of construction in the adjacent suburban areas, the prevailing wind conditions, and other similar factors. The recent report of the Board of Fire Underwriters regarding the City makes no mention what- s~ver o~ any conflagration potential existing adjacent to the city. Dated Narch 8, 19541.
