HomeMy WebLinkAboutRES NO 29-53RESOLUTION NO. 29- 5B RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAKERSFIELD, CALIFORNIA, CONFIRMING THE ASSESSMENT FOR THE CONSTRUCTION OF SANITARY SEWERS AND APPURTENANT WORK IN PLANZ ROAD AND OTHER STREETS AND ALLEYS, KNOWN AS PUBLIC IMPROVR~NT DISTRICT NO. 696 (PLANZ PARK ANNEX)~ AS PER RESOLUTION OF INTENTION NO. 696- , , , , , , , WHEREAS, the City Council of the City of Bakersfield did on the 23rd day of June, 1952 adopt Resolution! of Intention No. 696 for the constraction of sanitary sewers and appurtenant work in connection therewith in Planz Road and other streets and alleys, known as Public Improvement District No. 696; and WHERFAS, pursuant to proceeding had and taken by said City Council under said Resolution of Intention No. 696, a contract was entered into on the 2nd day of Jann~ry, 1953 by and between Joe D- Miller, as contractor, and J. Holfelder, as Superintendent of S%reets of said city, for the construction of said improvements; and WHEREAS, pursuant to Resolution No. 42-52 adopted by said City Council on the 4th day of August, 1952, the Rngineer of Work prepared, signed aml filed with the City Clerk on the 19th day of May, 1953 his assessment covering the costs and expenses of the construction of said improvements; and WRERFAS, notice of the filing of said assessment has~ been duly and regularly given by publication, posting and mailing, as required by law, and s aid notice fixed the 8th day of June, 1953 at the hour of eight o,clock (8:00) P. M. and the chambers of the City Council, located at 1620 Truxton Avenue in the City of Bakersfield, as the time and place when and where all persons, interested in the work done or in the assessment, would be heard by the said City Council; and - 1 - WHEREAS, at the request of the City Manager and Superintendent of Streets of said city, the said hearing was duly and regularly continued to the 15th day of June, 1953 at the hour of eight o,clock (8:00) P. M-and ~urther continued to the 22nd day o~ June, 195S,at the hour o~ S:O00'clock P. M. ~for further consideration by the said City Council. NOW, THERFFORE, THE CITY COUNCIL OF THE CITY OF BAKERSFIELD, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE, FIND AND ORDER AS FOLLOWS: That after a fair and impartial hearing having been granted to all persons desiring to be heard in the matter of the construction of sanitary sewers and sppurtenant work in Planz~ Road and other streets and alleys (Planz Park Annex) and all verbal objections presented, having been heard and fully considered, and the City Council being satisfied with the correcthess of the assessment and diagrsm, it is hereby determined that all appeals or objections be overruled and denied and that the assessment and diagram, together with the proceedings, be confirmed and approved and that the Superintendent of Streets shall forthwith attach a warrant to said assessment bearing the date of this resolution of the City Council. I HEREBY CERTIFY that the foregoing resolution was duly passed and adopted by the City Council of the City of Bakersfield, California on the 22nd day of June · 1953 by the following vote: AYES: Councilmen Carnakis, Collins, Croes, Eveleth, Sullivan NOES: ABSENT: Councilmen Vest Councilmen Maunders of the City Council of the City of BakerSfield, California APPROVED this 22nd day of June 1953- - 2 -
