HomeMy WebLinkAboutRES NO 20-53RESOLUTION NO. 20-53 WHEREAS, Section 25643 of the Government Code of ths State of California provides a procedure under which the County of Kern can exempt all property within the limits of the City of Bakersfield from county taxes levied for structural fire protection of areas in the County, and WHEREAS, the City of Bakersfield has a highly efficient fire department capable of furnishing fire protection to all structures in the City of Bakersfield, and WHEREAS, it has been proposed that this Council petition the Board of Supervisors of. the County of Kern that all property lying within the corporate limits of the City of Bakersfield, be exempted from the levy of county taxes for structural fire protec- tion of areas within said county during the fiscal year 1953-1954. NOW, THEREFORE, BE IT RESOLVED by the 'Council of the City of Bakersfiel d, that the Mayor of said city be and he is hereby authorized and directed to sign the above-mentioned petition and cause the same to be presented to the Board of Supervisors of the County of Kern. PETITION TO THE HONORABLE BOARD 0F SUPERVISORS OF 'THE CiOUNTY OF t9-'3HN, STATE OF CALIFORNIA: Pursuant to the provisions of Section 25643 of the Government Code of the State of California, the City. of Bakersfield does hereby petition your Honorable Body that all property within the corporate limits of said city be excepted from the lev~ of any and all county ta~es for structural fire protection of a~eas in the County of I[ern for the Fiscal Year 1953-1954. In support of this petition, t~$ follo~xing information is hereby submitted: 1. The City of Bakersfield has a modern municipal fire dopartF~nts and is rated by the National. Board of Fire Underwriters as a Class 3 City relative to the quality of fire protection and suppression; this is equivalent to the highest rating attained by any city in California, Pegardless of size or location. 0,a- fire department itself is graded as a Class. 2 Departnmnt, with. only t~enty-eight cities in the entire United States holding equal o~ higher rating., There can be no q~stion that the City of Bakersfield supplies, through its own organization and by means of taxes col- lected from ~ith!n the City, a measure of structural ripe protection which requires no continuing.support from any oth~r agency. 2.. The County fire department has responded to alarms witkin the co~porate limits of the city on only three occasions since its. organization, except for protective responses ~-rhtch sa~ ~ade by both the city and county when the exact location of a fire is unknown but lies close to the boundary line of! the city. On none of the three occasions in this period of over ten years has the city fire department requested such assistance. During this ten-year period, the city fire department has responded on fifteen (15) occasions to suppx~sss fire in publicly owned structures lying outside the city, ~-~hich included fir~s in road district yards, elementary schools, ~East Bakersfield High school, and Kern General Hospital, tn fact, by agre6mcnt bet~?~een .all. interested pa~ties, the city fire dep~t~nt. has accepted c+. .hief responsibility for the conduct of fire fighting operarings at the Kern C~neral 4,..~my conceivable benefit derived by the City of Bak~rsfleld through the ability of the County fire dep&vtmsnt tO combat strmctu~al fir~'s# is highly theoretical, Only in the instance of a major conflagration occurring in th~ county territorT, immediately a.dJ~.cent to t~ city boundsties, uould the coUnty department be of direct advantage to th~ city, Such a situation is extremely unliI~ely due to the type of constPuctton in t~e adjacent ~uburb~n m~eas, the prevailing ~.~ind conditions, 2rid othe~ simil~ factors, The ~ecent ~epo~t of the Board of Fi~e Unde~-~iters 'regarding the City makes no mention whatsoever of eny conflagPation potential existing adjacent to the city.
