HomeMy WebLinkAboutRES NO 66-52 RESOLUTION NO. 66-52 RESOLUTION ISLATING TO COOPERATION WITH THE HOUSING AUTHORITY OF THE COUNTY OF KERN IN THE DEVELOE.~VT OF LOW-RENT HOUSING PROJECT NO. CAL-8-6 WHEREAS, by Resolution No. 99, adopted the 22nd day of January, 1951, pursuant to the Housing Authorities Law of the State of California, the City Council of the City of Bakersfield (heretnafter called the "City") consented that the Housing Authority of the County of Kern operate in the City; and t,EEREAS, on January 29, 1951, the City Council of the City, pursuant to the Housing Authorities Law and !Yousing Cooperation Law of the State of California, approved and authorized the execu- tion of a Cooperation Agreement with the ticusing Authority of the County of Kern (heretnafter called the "Housing Authority" ) in relation to the development in the City of a project or projects consisting of approximately 250 dwelling units for families of low income; and WHEREAS, by Resolution No. 100, adopted January 29, 1951, the City Council of the City, among other ttdngs, approved (pursuant to Section 8(b) of the Housing Authorities Law) the development of a housing project for families of low income in the City, which was planned at that the for development in a then recently annexed area of the City kno~m as the "Sunset-l-~ayflower District", the site of which project is bounded on the north by Cs!ifornia Avenue; and WHEREAS, following the approval of the project on the part of the City Comncil and consultations by the Housing Authority w!~__h the Manning Commission of the City concerning the location of the project and its proposed Constr~tion as duplex dwelling units, the Housing Authority proceeded ~dth plans and specifica- tions and undertook to acquire title to the site for the said low-rent housing project for the development of approximately 2~/:-dwelling units identified as "Project CAL-8-6"; and WHEREAS, the said "Sunset-Mayflower District" was not subject to City zoning at the time the Housing Authority sought and obtained the approval of the Planning Commission for the development of the project within the "Sunset-~yflower District"; and ~HF~REAS, the City Co~Ancil, at about the time the Housing ~utbority commenced the acquisition of the lands for the project and without considering that fact, adopted interim zo~g Ordi~_~ce No. 923, New Series, on Septembe~ 17, 1951~ to restrict all development in the newly annexed area to singl~-f~fly resi- dential structures until necessary studies were made to properly classify the entire district; and WHEREAS, upon ~he approval of the City Council of the afore- said project and following consultations ~ith the Planning Commission of the City~ the Housing Authority, in reliance on those actions, acquired the site for the project and ezpended considerable sums for the preparation of p!~ns and specifications for its construc- tion; and WHEEEAS, on October 27~ 1952~ the City Council of the City of Bakersfield adopted Resolution No. 58~52, ~hich resol~tion, among other things, re-a~firmed the s~id Cooperation Agreement e~ecuted January 29, 1951; and ~REAS, after extended study and. consider~tion~ the City Council of the City of B~kersfie!d has proposed an~ the Housing Authority has agreed that the 130~foot frontage of the site o_~ the project on California Avenue should be zoned for commercial use and that the low-rent housing ~nits shall not be developed on this particular frontage; and ~,~REAS, the consequent reduction in th~ land are~ of the site~roposed makes possible the development on the rem~indar of the site of only appro~imately 18~ d~el!ing units of duplez construction; and ~.~REAS~ the Housing ~uthority~ ~n cooperation ~ith the City, -2- has designed the streets for the project o~rea to per~dt the installation of a new connecting li~{ for Ld{eview ~!vonue (Cottonwood Road) and proposes, -after the i:~orovement of certain p~rts of Lakevie~.r Avenue at the expense of the Housing Authority, to dedicate to the City the improved area and other areas required by the City to complete the Lake~-ie~.y ~venue ~ink~ s_nd ~;~EREAS, other streets in the project area are planned for vacztion and dedication and certain reservations are to be made for utility easements; and ~.~EREAS, the Housing Authority has submitted to the Council and the Council has examined a certain map dated October 22, 1952, prepared by Architect Robert N. Eddy, and entitled "Revised Project Site Plan 0ro Vista Project CAL-8-6"; and. , WFJEREAS, the Cooperation Agreament executed january 29, 1951, contains s~n agreement on the part of the City of Bakorsfield to make such changes in any zoning of the site and surrounding terri- tory of such _Uroject as are reasonable and necessary for the - development and. protection of such project and the surrounding territory; and Y,FF~REAS, the City Council finds that a change in the interim z~ning of that part of the-"Sunset-Mayflower District" described in this resolution to permit the'construction of duplex dwelling units, ~n admini.~tration snd maintenance building, and yard and a community hall is reasonable and necessary. for the develo~ent and protection of the low-rent housing project and the s~3rour~ding territory; and ., WHER3EAS~ the City Council finds that the proposed joint action of the Housing Authority and the City in the improvement cnd installation of the new connecting li~{ for Lakeview Avenue "(COt'~6hwood'R6ad) is in the~be~t"~.nt~rests of t~'e~ C=ity of Bs~sfield. NOW, THEREFORE, BE IT RESOLVKD BY T~FC GOU~!L OF T,F3E CITY OF BAKERSFIELD: 1. That the development by the Housing Authority of the County of Kern of approximately 18~ dwelling units for families -3- of low income on the site acquired by the Housing Authority in the "Sunset-Mayflower District" is approved; provided, that housing will not be developed on the approximately 130-foot frontage on California Avenue; provided, further, that the housing to be developed shall be constructed in multiples not greater than two. 2. That the proposed street and alley installation and the general layout and spacing of buildings sho~n on the map dated October 22, 1952, prepared by Architect Robert N. Eddy, and entitled "Revised Project Site Plan, Oro Vista Project CAL-8-6", is hereby approved and the City agrees tO the reservation of utility easements and to the vacations, dedications and the manner of improvement of the street and alley areas, all as indicated on the said map dated October 22, 1952, in conformity with the Cooneration Agree- ment, dated January 29, 1951 between the City and the Housing Authority of the County of Kern; provided, that the improvements. by the Housing Authority of the aforesaid street and alley areas as indicated on the said map shall be accomplished in accordance with the street and alley specifications normally required by the City of Bakersfield for such residential areas. 3- That a permit for the construction of the improvements identified in Paragraph No. i hereof shall issue; provided, that all structures developed in the project shall conform to the building code of the City of Bakersfield. ~- 4. That pursuant to the Housing Authorities Law and IIousing Cooperation Law of the State of California, the site hereinafter described is hereby rezoned to permit the construction of duplex dwellings, an administration and maintenance building and yard and a community hall, and the City Council of the City of Bakersfield, pursuant to the laws referred to, expressly approves the site here- ~fter- described for-~ the~~ development o~ approximately- 184~dwe! 1 ~ ng n~ts of the low-rent housing project known and described as Project CAL.8-6 of the Housing Authority of the County of Kern: (Paragraph No. 4 - continued) The following described properly lying and being ~.~ithin the Northeast quarter of Section 32, and the Northwest quarter of Section 33, To~mship 29 South, Range 28 East, M.D.B.& M., in the City of Bsd~ersfield~ County of Eern, California, described as follows: Beginning at a point on the Easterly line of Owens Street, said point being 150 feet Southerly from the Southeasterly intersection of ~ens Street and California Avenue. S~id point also being at the intersection of the Southerly line of a proposed twenty foot (20') wide Eact-:-Yest alley and the Easterly line of Owens Street; thence South O° 14' 18" East along the Easterly line of said Owens IStreet a distance of 427.98' to the beginning of a ~-rve concave to the Northeast, having a radius of 20' and a delta of 90° 00' 42"; thence Southeasterly along said curve~ thirty one and forty-t~To hundredths (31.423 feet to a point on the North line of Tenth Street; thence North 89° 45' East along the Northerly line of Tenth Street a distance of fourteen hundred, seventy and eighty-four hundredths (1_470.84 ~) more or less feet to the Southeast corner of Lot 52 of Tract No. 1301 as per map recorded in Boo~ 5, page 141 Official Eern County Records; thence North 0° 06' 30" East along the East line of said Lot 52 a distance of one hundred and twenty nine (129.00') feet, to ~e ~lortheast corner of said Lot 52; thence North 89° 45' East along the Northerly line of Lots 53 and 54 of said Tract No. 1301 and the easterly projection of the l~o~th~z~ly line of said Lots 53 and 54, a distance+ of one hundred and ei~'L~y-five (185.00 ½) more or less feet to a point on the Easterly line of Lakeview ~venue (also known as Cottonwood Road); said F~.ster!y line being thirty feet (30') E~st of the East line of said Section 32; thence South 0° 06' 30" E~Yest along the E~sterly line of said Lakeview Avenue to a point. That the Council hereby finds that the use of the lands described in Paragraph No. 4 hereof for the public buildings to be developed by the Housing Authority is necessary for the public health, safety, convenience, and welfare, and that the proposed lo~-rent housing project, ~!dch is a public institution of a charitable nature, will not be injurious to property or improvements, will not affect adversely neighborhood property, and ~dll not be detrimental to the health, safety, morals, comfort, convenience~ or general welfare of persons residing or working in the neighborhood of the project. 6. That a permit shall issue to the Housing Authority of the County of Kern for the use of the lends described in Paragraph No. 4 hereof. 7. That the adoption of Resolution No. 100 on January 29, 1951~ of the Council of the City of Bakersfield is hereby ratified, confirmed and approved and the Cooperation Agreement executed on January 29, 1951, is hereby ratified~ confirmed and approved as the valid s~ld e.xisting contract of the City of Bake~'sfield. 8. That all officers and employees of the City of D~ersfteld shall fm~liarize themselves ~dth the provisions of the Cooper~.tion Agreement executed January 29, 1951, and shall carry out their official duties in a ~_m_nner which will achieve compliance ~dth the terms of the Agreement and th~s Resolution. 9.
