RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF BAKERSFIELD, CALIFORNIA,
DIRECTING RE-ADVERTISENENT FOR BIDS
FOR CONSTRUCTION OF SANITARY SEWERS
AND APPUR~ WGRK IN CONNECTION
THEREWITH IN PLANZ ROAD AND OTHER
STREETS ~D ALLEYS, KNOWN AS PUBLIC
IMPROVEMENT DISTRICT NO. 696

WHEREAS, the City Council having heretofore on th~
25th day of August, 1952 received bids for the construction of
sanitary sewers and appurtenant work in connection therewith in
Planz Read and other streets and alleys, known as Public Improvement
District No. 696 (Planz Park Annex), as contemplated by Resolution
of Intention No. 696 adopted by the City Council of said City on
the 23rd day of June, 1952;~ and
WHEREAS, the s aid bids and each of them were returned
to the bidders un-opened by reason of the fact that the City Attommey
had reported to this City Council that an appeal had been taken from
the decision of the trial court holding the annexation valid, as
particularly described in Ordinance No. 898 (New Series), adopted by
this City Council on the 2rid day of January~ 1951; and
WHEFJAS, the said City Attorney has now reported to this
City Council that the said appeal, taken from the decision of the
trial court, had been dismissed by the appellant and that the annexation
of said Planz Park, as per said Ordinance No. 898 (New Series), now
becomes final; and
WHEREAS, this City Council does hereby find that the
public interest and necessity requires the re-advertisement for bids
for t he construction of said sewer mains and appurtenant work as a
much needed health measure; and
WHEREAS, pursuant to the provisions of Section 5245 of
the "Improvement Act of 1911", it is within the power of the City
Council to re-advertise for and receive bids under proceedings heretofore
initiated under said Resolution of Intention No. 696 and to let a contmct
to the lowest, regulsr, responsible bidder.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Bakersfield, California, as follows:
That the City Clerk of said City be, and she is
hereby, directed to post conspicuously for five (5) days on or
near.the chamber door of the City Council, in th~ manner and
form required by the "Improvement Act of 1911"., a Notice
Inviting Sealed Proposals or Bids for doing the work described
in Resolution of Intention No. 696 adopted June 23, 1952, and
the City Clerk is hereby further directed to publish twice
in the "Bakersfield Californian,,, a daily newspaper published
and circulated in said City and hereby designated by this
City Council for such publication, a notice inviting.such
proposals or bids for doing said work and referring to the
specifications on file.
I HEREBY CERTIFY that the foregoing resolution was
duly passed and adopted by the City Council of the City of
Bakersfield, California, on the ~,~ day of ~~J
