HomeMy WebLinkAboutRES NO 33-52 33-52 RESOLUTION NO o RESOLDTION OF THE CITY COL~qCIL OF THE CITY OF BAKERSFiEID~ CALIFORNIA~ APPOINTING THE ENGINEER OF WORK IN THE MATTER OF PROPOSED CONSTRUCTION OF SANITARY SEV~ERS AND APPUErENANT WORK IN ',.PUBLIC IMPROVEMENT DISTRICT NO. 696"' WITHIN SAID CITY A~D IN CERTAIN UNINCORPORATED TERRITORY OF THE COUNTY OF KERN~ STATE OF CALIFORNIA° , % , , , , WHEREAS~ it is contemplated and it is the intention of the City Council of the City of Bakersfield, California, proceeding under the provisions of the ".Improvement Act of 1911''~, Division VII of the Streets and High~ays Code of the State of California., to carry through proceedings for the construction of sanitary sewersi and appurtenant work in connection therewith within that certain porti on of Plsm~ Park Annexation lying South of Wilson Road within said City, and which improvement also includes a certain portion of the unincorporated territory of the County of Kern in Plan~ Road between the Easterly boundary of said City and the center line of South Chester Avenue, said improvement to be kn~vn and hereafter designated as PUBLIC ~OVE~ENT DISTRICT NO. 696~ V~EREAS, pursuant to the provisions of Section 5701 of said "T~mprovement Act of 1911"', it has been recommended by the City Nanager of said City that a registered civil engineer be appointed, to be known as "Engineer of Work':, other than the City Engineer or in place of the City Engineer, for the purpose of .pre~paring surveys~ maps, drawings, plans, profiles~ and specifications for the construction of said sanit~ sewers under said Act within said PUBLIC IMPROV~ENT~ DISTRICT NO o 696. N~V, THEREFORE~ BE IT RESOL~F~ by the City Council of the City of Bakersfield, California, as follo~s~ SECTION lo That R. E° White, a civil engineer registered under the laws~ of the State of California as a civil engineer and having his - i - office and principal place of business at 1716 Oak Street, Bakersfield, California, be, and he is hereby appointed Engineer. of ~ork in the above mentioned matter to take charge of and perfect such engineering and incidenta~l work as hereinafter provided for. SECTION 2. That the said R. Eo V~ite shall do, or cause to be done and performed, all the necessary and proper engineering work such as making surveys, the prepara~tion of maps, plans, drawings~, profiles, estimates, specifications, estimating costs~, computing bids, supervision and inspection of construction, together. with the figuring and estimating of and preparing the assessments on the various parcels of property within the assessment district at the completion of the work, together with the Street Superintendent~s record covering the costs and assessment of said improvement; That the said services shall also include the furnishing of all office and field engineez~_ng supplies and equipment required in connection with the performance of the duties~'of such Engineer of Work, together with transporta~tion and testing of materials~, whenever necessary, used in the construction of said improvement, and shall also include all necessary stationery and supplies in the preparation of said assessment; That the said services shall also include, without further' compensation from the City of Baker.sfield, a pers~on qualified to assist-I in preparing the resolutions, notices and other papers. and proceedings for any and all work authorized by the City Council of said City in the matter of said PUBLIC INPROV~.NT DISTRICT NOo 696; That said services shall also include the furnishing of four complete sets-of plans and specifications covering said improvements charge without any additional/to said City, and all additional plans~ and specifications shall be paid for by the assessment district at the actual cost to the said Engineer of Work° - 2 - SECTION 3. That the compensation of said R. E. White for the performance of the duties. as such Engineer of Work, as. herein provided, is hereby fixed at an amount equal to eleven and one-half per cent (ll~) of the total construction cost of said improvement, which compensation shall be included ~s. incidental expenses and become a. charge against the special assessment dist~_ct for said improvement, and also the said compensation shall include the services. of A. S. Nonroe, a registered civil engineer, to assist the said Engineer of Work and the officers of the City of Bakersfield in the preparation of said resolutions, notices and other papers~ and proceedings for any work authorizsd by said "Improvement Act of 1911~', in connection ~ith said PUBLIC INFROVE~.NT DISTRICT NO. 696. Payment of such compensation shall be made as follows!~ An amount equal to six per cent (6%) of the bid price of said construction cost shall be collected from the contrs~ctor as incidental expenses and shall be paid to the said Ro E. White v~ithin fifteen (15) days from the date of the signing of the contract for such improvement~ the balance or final payment of said compensation of ll~ of. the tota~l construction cost shall be due and payable to the said Ro E. White within fifteen (15) days after the recordation and delivery of the asssssment and warrant to the cbntractor or his assignee by the Superintendent of Streets of said City, less any sums of money theretofore adv~nced to the said Ro E. White as. psrtial payment fo~ such engineering services. SECTION ~. That in the event any of the proceedings initia~ed for such improvements cease or are abandoned and the project is not consummated as proposed~ after said Engineer of Work h~s prepared the necessary surveys and plans accordingly~ then and in t~It event the City of Bakersfield, in considera~tion of the performance - 3 - of the work by the said Engineer as hereinabove provided, shall. reimburse the said Engineer for such services to the amount of one hundred twenty-five per cent (125%) of the salary payments, plus withholding for Federal income Tax, Social Security and Unemployment Insurance of the employees of the Engineer engaged in the performance of said work, following the customary accounting proCedure~ plus sums equal to any other direct costs incurred by the Engineer in connection ~ith such services~ including reimbursements and allowances for said employees for transportation and subsistence and including the time actually incurred by the said A. S. a~t the rate of thirty-five dollars ($35.00) per day~ of seven hours each, for the p~eparation of any proceedings~ together~ with hotel e~xpenses and automobile allowance of seven cents. (7~) per mile, provided that the total per diem compensation of A. S. Monroe~ exclusive of expenses-~ shall not exceed one-half of one per cent (1/2 of 1%) of the estimated construction cost in case of such abandonment. AND BE IT FURTHER RESOLVED~ that pursuant to the provisions of Sections 52S~ and 52S4 of said "Improvement Act of 1911"~ of said Code~ the construction of said sanitary sewers~ and appurtenant work in connection therewith v~ithin said PUBLIC LV~ROVEMENT DISTRICt' NO. 696, including certain unincorporated territory of the County of Kern, operating under consent of the Board of Supervisors of said County~ shall be done under the direction and to the satisfaction of said Engineer of Work and that the materials used shall comply with the specifications and be to the satisfaction of such Engineer of Work instead of the City Engineer and/or Superintendent of Streets. of said City~ and that the said Engineer of Work shall make, sign and file the assessment or assessments at the completion of the work instead of the Superintendent of Streets of said City~ provided, however~ that the contract to be entered into for the construction of such improvements shall be signed by the Superintendent of Streets of said City, and that when the assessment for said improvements. is confirmed by the City Council of said City, the said Superintendent of Streets shall attach a warrant to said assessment bearing the date of csuch confirmation and record the said assessment, diagram and warrant in his office. AND., BE IT FURTHER RESOLVED that the Clerk Of this City Council is hereby directed to certify and deliver a copy of this; Resolution to the said R. E.
