H-5~j< RESOLUTION DETE}~INING THE NECES- SITY AND FEASIBILITY OF THE WORK AS SET FORTH IN THE ENGINEER'S REPORT IN THE MATTER OF PUBLIC IM- PROVEMENT DISTRICT NO. 687. WHEREAS, the City Council of the City of Bakersfield, California, did by Resolution No. 61-51, passed and adopted on November 19, 1951, pursuant to statute, approve the written report prepared and signed by the City Engineer in accordance with the provisions of that certain act of the Legislature of the State of California known as the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931", being Division 4 of the Streets and Highways Code, and did on said date fix Monday, the 7th day of January, 1952, at the hour of 8 o,clock P. M., as the day and hour, and the Council Chamber of the City Council in the City Hall in the City of Bakersfield as the place of hearing on such report; and WHEREAS, the City Clerk of said City thereafter deposited in the United States mail, with postage prepaid, written notices of the time and place of hearing upon said report, all in the time, manner and form required by said Act; and WHEREAS, said hearing has been held and said report has been read and considered at said hearing. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF BAKERSFIELD, as follows: 1. That protests in writing have not been filed by the owners (as defined in the "Street Opening Act of 1903" and amendments thereof) of a majority of the area of the lands to be assessed within the proposed assessment district, as said dis- trict is defined in said written report. 2. That the estimated amount proposed to be assessed upon some parcels of land for the proposed acquisition will exceed one-half (1/2) the true value of such parcels as set forth in said written report. 3. That the total estimated cost of the proposed acquisition, when added to the aggregate totals of all unpaid assessments and estimated assessments, as such totals are stated in saidwritten report, will not exceed in total amount one-half (1/2) of the total true value of all the lands proposed to be assessed. BE ITFURTHERRESOLVED: 1. That notwithstanding the fac~ that the estimated proposed assessment to be levied upon some parcels of land proposed to be assessed for said proposed acquisition, will exceed one-half (1/2) the true value of suchparcels, this Council hereby finds and determines that the proposed acquisition is feasible and that the lands proposed to be assessed to pay the costs and expenses thereof will be able to carry the burden of such proposed assessment. 2. That the public interest, convenience and necessity require said proposed acquisition as set forth in the said report of the CityEngineer. 3- That the limi+~tion on assessments provided in said "Special Assessment In~stigation, Limitation and Majority Protest Act of 1931" may be disregarded. o I NEEBY CERTIFY that the foregoing Resolution was passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on the 7th day of January, 1952, by the following vote: AYF~: OARNAKIS, SAUNDERS, SHURLEY, SULLIVAN, VANDERLEI, VEST ~O~ ,...~ ..........................................."- ABSENT: m ....... ~--~- ------ -- ..... .-. _ .--,_ .~ City Clerk and Ex-Officio Clerk of the Council of the City of Bakersfield.
