Z~_ g ~ RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAKERSFIELD, CALIFORNIA, RE~,UESTING CONSENT OF COUNTY OF KERN TO CONSTRUCT CERTAIN HOUSE CONNECTION SE~_~RS WITHIN A PORTION OF A PUBLIC STREET IN SAID COUNTY W}EREAS, the Board of Supervisors of the County of Kern, California did on the 15th day of September, 1947 adopt a resolution wherein the said Board formed and created the Union Avenue Sanitation District under the provisions of the "County Sanitation District Act ", Chapter 3, Part 3, Division VI of the Health and Safety Code of the State of California; and WHEREAS, subsequent to the formation of said Sanitation District, a portion thereof, through proceedings had and taken, was annexed to and is now included ~ithin the corporate limits of the City of Bakersfield, which portion is commonly known and referred to as EL CANINO PARK ANNEX, and said annexed portion has been duly excluded from said Sanitation District pursuant to proceedings had and taken under the provisions of said "County Sanitation District Act"; and Y~HF~KEAS, it is the intention of the City Council of the City of Bakersfield to order the construction of a sanitary sewer system within a portion of said EL CANINO PARK ANNEX, under the provisions of the ,,Improvement Act of 1911" , Division VII of the Streets and Highways Code of the State of California; and WHEREAS, the Engineer of Work for s aid City, in designing certain house connection sewers to serve a certain area of the County of Kern lying immediately South of the South boundary of said City, has found it necessary to encroach upon a portion of Casa Loma Drive lying within the unincorporated territory of the County of Kern; and - i - V~EREAS, the assessment district for such improvement (as proposed) in the matter of the construction of said improvements, will include that portion of the unincorporated territory of the County of Kern hereinafter particularly described; and WHERF~S, pursusat to Section 511? of said "Improvement Act of 1911" of said Streets and Highways Code, with the consent of the legislative body having jurisdiction over the territory within which it is proposed to construct any such improvements, expressed by resolution of such governing body, the said City Council of s aid City may order the construction of s aid sewers m d appurtenances ~ NOW, THEREFORE, BE IT RESOLVED that the consent of the legislative body of the County of Kern, California, expressed by resolution, is hereby requested to: First. Construct and maintain house connection sewers in the Southerly portion of Casa Loma Drive to serve Lots ~l to 28, both inclusive, of Tmct 1312. Second. Include within the boundaries of the proposed assessment district for the said improvements that portion of the unincorporated territory of the County of Kern, particularly described as follows= Lots ~l to ~8, both inclusive, of T~a ct 1312~ as per map recorded in Map Book 5, Page 157, Records of Kern County, California, and that portion of the N.E. 1/h of the N.W. 1/~ of Section 7, Township 30 S., Range 28 E., bounded as follows: on the North by the South line of Casa Loma Drive; on the West by the East line of s aid Tract 1312 and Northerly prolongation thereof; on the South by a line 160.~2 feet Southerly from and parallel with the Southerly line of Casa Loma Drive; and on the East by the Southerly prolongation of the East line of the first alley lying Easter~ly from and parallel with E1 Toro Drive. - 2 - Third. Commencement and completion of the proceedings for said construction and assessment by the said City Council of said City and to the exercise of jurisdiction by said City Council under the proceedings necessary or proper for the purpose of con- summating the same, all in accordance with the provisions of said "Improvement ,Act of 1911" of said Streets and Highways Code, AND, BE IT FURTHER RESOLVED that a certified copy of this resolution be filed with the County Clerk of the County of Kern and Ex-officio Clerk of the Board of Supervisors of said County, together ~ith a map showing such house connections and property to be assessed within the unincorporated territory, I PEREBY CERTIFY that the foregoing resolution was duly passed and adopted by the City Council of the City of Bakersfield on the ~ day of ~o .Z~~] , 1951 by the following vote: NOES: C ounc ilmen ~ · . o , ABSENT: Councilmen ~ ~. , APPROVED this ~_~day City Clerk and Ex-officio Clerk of the City Council of City of Bakersfield, California Of ~ ~a ~ Mayor of the City of Bakersfield, California - 3 -
