HomeMy WebLinkAboutRES NO 51-51mSSOt T ON NO, FI- RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAKERSFIELD, CALIFORNIA, APPOINTING THE ENGINEER OF V~ORK IN THE MATTER OF PROPOSE CONSTRUCTION OF SANITARY SE~~~EP~S AND APPUR- TENANT WORK IN" PUBLIC IMPROVE ,NENT DISTRICT NO. 689" WITHIN SAID CITY AND IN CERTAIN UNINCORPORATED TERRITORY OF THE COUNTY OF KERN, CALIFORNIA. , , , , , , V~tERF~S, it is contemplated and it is the intention of the City Council of the City of Bakersfield, California, proceeding under the provisions of the "Improvement Act of 1911", Division VII of the Streets and Highways Code of the State of California, to carry through proceed- ings for the construction of sanitary sewers and appurtenant work in connection therewith within that certain portion of said City, commonly known and referred to as E1 Camino Park Annex, and which improvement also includes a certain portion of the unincorporated territory of the County of Kern lying South of Casa Loma Drive, said improvement to be known and hereafter designated as PUBLIC IMPROVEMENT DISTRICT NO. 689; and WHEREAS, pursuant to the provisions of Section 5701 of said "Improvement Act of 1911", it has been recommended by the City Manager of said City that a registered civil engineer be appointed, to be known as "Engineer of Wor~', other than the City Engineer or in place of the City Engineer, for the purpose of preparing surveys, maps, drawings, plans, profiles and specifications for the construction of said sanitary sewers under said Act within said PUBLIC IMPROW~NT DISTRICT NO. 689. NOW, THEREtO RE, BE IT RESOLVED by the City Council of the City of Bakers field, California, as follows: SECTION 1, That R. E. White, a civil engineer registered under the laws of the State of California as a civil engineer and having his office and principal place of business at 1716 Oak Street, Bakersfield, California, be, and he is hereby, appointed Engineer of Work in the - 1 - above mentioned matter to take charge of and perfect such engineering and incidental work as hereinafter provided for. SECTION 2. That the said R. E. White shall do, or cause to be done and performed, all the necessary and proper engineering work such as making surveys, the preparation of maps, plans, drawings, profiles, estimates, specifications, estimating costs, computing bids, supervision and inspection of construction, together with the figuring and estimating of and preparing the assessments on the various parcels of property within the assessment district at the completion of the work, together with the Street Superintendent,s record covering the costs and assessment of said improvement; That the said services shall also include the furnishing of all office and field engineering supplies and equipment required in connection with the performance of the duties of such Engineer of'Work, together with transportation and testing of materials, whenever necessary, used in the construction of said improvement, and shall also include all necessary stationery and supplies in the preparation of said assessment; That the said services shall also include, without further com- pensation from the City of Bakersfield, a person qnalified to assist in preparing the resolutions, notices and other papers and proceedings for any and all work authorized by the City Council of said City in the matter of said PUBLIC IMPRO~T DISTRICT NO. 689; That said services shall also include the furnishing of four complete sets of plans and specifications covering said improvements without any additional charge to said City, and all additional plans and specifications shall be paid for by the assessment district at the actual cost to the said Engineer of Work. SECTION 3. That the compensation of said R. E. White for the performance of the duties of such Engineer of Work, as herein provided, is hereby fixed at an amount equal to eleven and one-half per cent (ll½%) of the total construction cost of said improvement, which compensation - 2 - shall be included as incidental expenses and become a charge against the special assessment district for s aid improvement, and also the said compensation shall include the services of A. S. Monroe, a registered civil engineer, to assist the s aid Engineer of Work and the officers of the City of Bakersfield in the preparation of s aid resolutions, notices and other papers and proceedings for any work authorized by said "Improvement Act of 1911" , in connection with said PUBLIC INPROVEMENT DISTRICT NO. 689. Payment of such ccmpensation shall be made as follows: An amount equal to sLx per cent (6%) of the bid price of said construction cost shall be collected from the contractor as incidental expenses and shall be paid to the said R. Eo White within fifteen (15) days from the date of the signing of the contract for such improvement~ the balance or final payment of said compensation of 112!% of the total construction cost shall be due and payable to the said R. Eo White within fifteen (15) days after the recordation and delivery of the assessment and warrant to the ccatractor or his assignee by the Superintendent of Streets of said City, less any sums of money theretofore advanced to the s aid R. E. White as partial payment for such engineering services. SECTION ~. In the event that any of the proceedings initiated for such improvements cease or are abandoned and the project is not con- sumhated as proposed, after said Engineer of Work has prepared the necessary surveys and plans accordingly, then and in that event the City of Bakersfield, inlconsideration of the performance of the work by the said Engineer as hereinabove provided, shall reimburse the said Engineer for such services to the amount of one hundred twenty-five per cent (125%) of the salary payments, plus withholding for Federal Income Tax, Social Security and Unemployment I~urance of the employees of the Engineer engaged in the performance of said work, following the customary accounting procedure, plus sums equal to any other direct costs incurred by the Engineer in connection with such services, including reimbursements and - 3 - allowances for said employees for transportation and subsistence and including the time actually incurred by the said A. S. Monroe at the rate of thirty-five dollars ($3~.00) per day, of seven hours each, for the preparation of any proceedings together with hotel expenses and automobile allowance of seven cents (7~) per mile, provided that the total per diem compensation of A. S. Monroe, exclusive of expenses, shall not exceed one-half of one per cent (1/2 of 1%) of the estimated construction cost in case of such abandonment. AND BE IT FURTHER RESOLVED, that pursuant to the provisions of Sections ~283 and ~28h of s aid "Improvement Act of 1911" of said Code, the construction of said sanitary sewers and appurtenant work in connection therewith within s aid PUBLIC IMPROVEMENT DISTRET NO. 689, including certain uni_ncorporated territory of the County of Kern, operating under consent of the Board of Supervisors of said County, shall be done under the direction and to the satisfaction of said Engineer of Work and that the materials used shall comply with the specifications and be to the satisfaction of such Engineer of Work instead of the City Engineer and/or Superintendent of Streets of said City, and that the said Engineer of Work shall make, sign and file the assessment or assessments at the completion of the work instead of the Superintendent of Streets of said City, provided, however, that the contract to be entered into for the construction of such improvements shall be signed by the Superintendent of Streets of said City, and that when the assessment for said improve- ments is confirmed by the City Council of said City, the said Superintendent of Streets shall attach a warrant to s aid assessment bearing the date of such confirmation and record the said assessment, diagram and warrant in his office. AND, BE IT FURTHER RESOLVED that the Clerk of this City Council is hereby directed to certify and deliver a copy of this Resolution to the said R. E. White.
