HomeMy WebLinkAboutRES NO 48-51RESOLUT O A RESOLUTION FINDING AND DETERMINING TME SUFFICIENCY OF A PETITION FILED IN THE MATTER OF PUBLIC IMPROVE~ENT DISTR~CT NO. 690. WHEREAS, there was filed ~ th the City Clerk of the City of Bakersfield on the 12th day of September,. 1951, a petition from the owners of property situated in the district described therein for the following described work and improvement: The improvement of that certain public easement thirty feet in width, extending northerly and southerly° parallel with and equidistant from the westerly right of way line of Oakdale Drive and the easterly right of way line of Wetherly Drive, from the northerly boundary line of "Tract No. 1397" to the southerly boundary line of "Tract No. 1397" by the construction of a 30-inch Portland Cement concrete irrigation pipe line in and along the center line of said public easement to replace the open irrigation canal now being maintained in and along said public easement, excepting from said construc- tion a 60-foot section or segment across Verde Street. Said 30 foot public easement, said right of way lines of Oakdale Drive and Wetherly Drive, said boundary lines of "Tract No. 1397" and said Verde Street, are shown and delineated on the map of "Tract No. 1397", filed for record in the office of the County Recorder of Kern County, California, on pages 67 and 68 in Book 6 of Maps on the 25th day of September, 1947. and WHEREAS, the City Clerk has certified that she has compared the signatures appearing on said petition with the report of owners furnished by the Title Insurance and Trust Company and finds that said petition is signed by all the owners of property described in her said certificate, and . WHEREAS, the City Engineer has reported to this Coun~c_il_ that he has compared the total area of the property, all the owners of which have signed said petition, as indicated by the aforesaid certificate of the City Clerk, with the total area of all property located in the district described in said petition subject to assessment for said work and improvement and finds that the combined area of the property listed on said certificate of the City Clerk is more than sixty per cent (60%) of the total area of all property -1- located in the district described in said petition subject to assess- ment for said work and improvement, and WHEREAS, the City Council has duly considered said petition and the certificates of City Clerk and City Engineer with reference to the proposed improvement referred to in said petition, and the sufficiency of said petition. NOW, 'THEREFORE, THE CITY COUNCIL OF THE CITY OF BAKERSFIELD DOES HEREBY RESOLVE, determine, find and order as follows: 1. That the work and improvement referred to in said petition is to be done under the provisions of the "Improvement Act of 1911",Division 7 of the Streets and Highways Code of the State of C aliforni a. 2. That this City Council does hereby find and determine that the qualified signatures to said petition, as shorn by the report of such owners furnished. by the Title Insurance and Trust Company, ame the signatuPes of all the owners of more than sixty per cent (60~o) in area of all the property subject to assessment for s aid work and improvement. 3. That this City Council does hereby further find and determine that the said petition for said work and improvement complies with all the requirements of the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931" being Division 4 of the Streets and Highways Code of the State of California, and in particular with the provisions of Section 2804 of said Code, and the City Council intends to meet each and every condition and make each and every finding necessary on its part in order to permit the proceedings for said work and improvement to go forward to completion without further reference to or application of the provisions of said Division 4 of said Streets and Highways Code. 4.
