' ~ OF THE CITY OF BAKERSFIELD EXPRESS-
ING ITS OPPOSITION TO ASSEMBLY BILL
. N0.'1981.
WHEREAS,, there is pendin~~' in the Assembly of the State of
California a bill numbered 1981, entitled An Act to Amend Section 43
of the Public Utilitiee. Act, Relating to Public Utilities, the
effect of which, if passed, would be to materially increase the
cities,-and other public agencies, share of the cost of grade sep-
arations approved by the State Public Utilities Commission, and
WHEREAS, the high cost to cities and other public agencies
of grade separations u:der the present system of allocation of costs
administered by thee Public 'Utilities Commission already effectively
prevents the construction of many such separations which are sorely
needed and the passage of Assembly Bill No. 1981 will further impede
or prevent the'development of a sound program of construction of
needed grade separations, and
WHEREAS, the necessity of grade separations is occasioned by
the existence of the railroads, which are operated for the purpose
of private profit, in e~ngeeted districts, and said railroads should
be required to contribute substantially to the alleviation. of those
conditions which they help to create, and
WHEREAS, said Assembly Bill No. 1981 represents an attempt
to settle litigation now pending b'efore the Public Utilities Com-
mission and to transfer to public agencies all of the cost of grade
separations, a major portion of which should be borne by the rail-
road s.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Bakersfield, California, sitting in regular session this
21st day of May, 1951, does'hereby'express its disapproval of said
Assembly Bill No. 1981, and ~es hereby urge the Legislature of
the State of California not to pass the+ same.
RE IT FURTHER RESOLVED that a certified copy of this Resolution
be forwarded~, to each of the .following:· the Honorable John W. Evans,
Chairman of the Assembly Committee on Public Utilities and Corpora-
tions; the Honorable Jess R. ~Dorsey, Senator from the Thirty-Fourth
District, .and-the Honorable H. W. Kelly, Assemblyman from the
Thirty-Ninth Di strict. I .

I HEREBY CERTIH that the foregoing Resolution was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the 21st day of May, 1951, by the following
