RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
BAKERSFIELD RELATING TO RENT COANTROL.
WHF~REAS, Section 204 (j) (3) of the Housing and Rent .Act of
1947 as amended in 19%0, provides in effect that the Housing Expediter
shall terminate rent control in any city upon receipt of a resolution
of its governing body, adopted for that purpose in accordance with
applicable local law and based upon a finding by such governing body
reached as a result of a public hearing held after ten days' notice
that there no longer exists such a shortage in rental housing accommoda-
tions as to require rent control in such city, 'and
WHEREAS, on July 24, 19~0, that certain organization known and
designated as the Kern County Property Owners' Association filed a
petition signed by certain residents of the City of Bakersfield, requesting
this Council to hold a public hearing in accordance with said Act and
that after said hearing, if it is found that such shortage no longer
exists, that this Council adopt a resolution to that effect, and
WHerEAS, the Council of the City of Bakersfield by resolution
passed and adopted on the lath day of .August, 19~0, fixed Tuesday, the
29th day of August, 19~0, at eight o'clock P. N. at the Washington School
Auditorium, Baker and Niles Streets, Bakersfield, California, as the
time and place of public hearing, when and where any and all persons
having an interest in said matter or desiring to appear before said City
Council regarding the question as to whether or not there still exists
such a shortage in rental housing accommodations as to require rent
control in the City of Bakersfield would be heard by said Council, and
~TEREAS, notice of the time and place of such public hearing
was given by publishing a copy of said resolution in the Bakersfield
Californian, a daily newspaper printed, published and circulated in the
City of Bakersfield, not less than ten days prior to the date of such

hearing, and by forwarding a certifisd copy of said resolution to the
Regional Housing Expediter, the Director of the local Area Rent Officer
and to the Kern County Board of Supervisors, and
V~HERE&S~ the City Councilof the City of Bakersfield held a
public hearing at the timer date and place and for the purposes set
forth in the aforesaid resolution, and at such public hearing all
interested persons were given a reasonable opportunity to be heard
with the right to be represented by counsel, and
~F_RE&S~ the proceedings at said hearing were recorded by a
shorthand reporter, and
WHEREAS, the City Council of the City of Bakersfield has duly
considered ali the evidence presented at said hearing~ and taken the
same under advisement,
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of Bakersfield does hereby find and determine as follows:
That there no longer exists in the City of Bakersfield such a
shortage in rental housing accommodations as to require rent control
in such city.
BE IT FURTHERRESOLVED that a certified copy of this resolution~
together with a certified copy of the resolution of this Council adopted
on August 14, 19~0, setting the time and place of public hearing on the
question of whether or not rents shall be decontrolled in the City of
Bakersfield, and a certified copy of the record of the proceedings at
~aid hearing, be forwarded to the Office of the Housing Expediter~
Washington 2~ D. C.
I HEREBY CERTIFY that the foregoing ResolUtion was passed and
adopted by the Council of the City of Bakersfield as a regular meeting
