NO. 33-49
WHEREAS, the Chief of Police, in s statement published
in s local newspaper, declared that he has repea.tedly informed
the Mane. get and the City Council that if they ere not satisfied
with the way he runs the Police Department or the conditions
in the City all he needs is a written order telling him ~ha.t
they think is wrong and what action he should take, in which
statement he claims that he has never received such order or
even a suggestion from the Maria.get or Council;
AND, WHEREAS, it is to be inferred from such sta.tement
that the Chief requires a written order to do his sworn duty
and to observe and comply with his official oath of office;
NOW, THEREFORE, in order that.there may be no misunder-
standing on the part of the Chief or on the part of shy other
officer of the department and in order that the matter may be
put in writing a.s the Chief seems to require, be it resolved
that the Council is una. ltersbly and unequivocally opposed to
poiice toleration of gambling, slot-machines, and vice in all of
their forms and wherever they may exist and by whomsoever such
crimes may be practiced; that the Council has always considered
and now considers that it is the plain and sworn duty of the
Chief and of every member of the department to suppress such
crimes ss w~ll as all other crimes to the fullest extent of their
s~ility without any written or other orders; that the tolerance
by the police of gambling, slot-me.chines, and/or vice or other
unlawful practice in shy form or plsce has s direct tendency to
weaken and corrupt the police force, to debase the morals of the
community, to deprive citizens and property of protection from
such unlswful elements, to invite sn influx of prostitutes,
gsmblers, hoodlums end gsngsters with sttendsnt underworld vio-
lence, end to mske the City sn ostensible pertnet in vice end
crime;
AND BE IT FURTHER RESOLVED thst this City Council here~y
declsres its unaltersble intention to beck ~nd support the
Msnsger to the limit in his efforts to discipline the Chief end
sny other member ofthe Police Force who msy be found guilty of
violetion or neglect of. his duty or of sny other unlswful
conduct; snd that we resent, sbhor and refuse to tolerste intimi-
dstion, scurrilous slender end defsmstion of the Msn~ger,
violence~ thrests of violence, or other gangster-like methods
~hich hslve been or msy be used to obstruct the Mar~ger in the
performsnce of his unplesssnt duty.
And, be it further resolved thst this resolution be entered
®n the minutes of this Council ss s perm~nent declsrstion of
policy for the guidsnce of the Police Depsrtment end sny member
thereof who msy feel the need of written directions for the
performance of his plcin duty.
I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield
at a regular meeting thereof held on the 17th day of October, 1949,
by the following vote:
