HomeMy WebLinkAboutRES NO 18-48 RESOLUTION NO. 18-48 RESOLUTION 0~ TiT~ CITY COUNCIL 0F ThNE CITY 0F B,~NERSFI'-,~V~D, C.~dLIi~0RNIA~ GRANTING CONSEI~ T0 T~ COUNTY OF ~(~N .&i~D THE R&NOR&I~Z~& SAi~= T.aTION DiSTRICT~ TO TE CONSTRUCTION~ Ivi,&IN- TEN~NCE Ai~D OPERATION 0F CERTAIN SAiqITARY SE~n~XR t~iAINS IN CERTAIN STREETS WITEN TE CITY 0F W~E&S~ the Board of Supervisors of the County of i(ern~ C~i- f. ornia~ has by Resolution adopted on .the !Oth day of ~ay~ 19~8~ requested consent for the construction~ 'maintenance~ and operation of certain sanitary sewer mains to be constructed for said district in portions of certain streets within the corporate limits of the City of Bakersfield~ a~d Wi~i~AS~ the cost of the construction of said sewer mains is to be totally assessed or taxed to the lands within said Sanitation District~ exclusive of any lands lying within the corporate limits of the said City of Bakersfield; and '~EAS~ pursuant to the provisions of Section ~117 of the "of the Streets and Highways Code~ and Sec- "Improvement Act of 1911 ~ . tion 4770 oi' the "County Sanitation District Acts" of the Health and Safety Code~ it becomes necessary in order that such construction may be made within the streets of said City, that consent of the legislative body of' said City expressed by resolution shall be given for such construction~ maintenance and operation; and ~EAS~ a cer'tified copy of a resolution of the Board of Super- visors of the County of Kern~ requesting consent of the City of Bakers- field to the construction~ maintenance and operation of said sewer mains has been filed with the City Clerk and Ex-0fficib Clerk of' the City Council of said City of Bakersfie!d; and ?~i:Ei~S~ the City Council of the said City of Bakersfield has examined the maps and proi'iles presented with said resolution requesti~ consent~ which said maps and profiles show the lo.pations of such proposed construction and the City Council is familiar with the things proposed to be done thereunder. NOW, TPZEREFORE., BE IT RESOLVED by the City Council of the City of Bakersfield, California, as follows: That' the public interest~ convenience and necessity require the location, construction and maintenance of certain sewer mains within the public streets of the City of Bakersfieldi as follows.' in BEALE .&VEI]TjE between the Easterly .City Limits of the City of Bakersfield and a point % feet Northerly of the center line of Grace Street; and in GR&CE STREET between said City Limits and a point 10 feet Easterly of the center line of Beale Avenue; and in II\~ZO STREET between the Northerly City Limits of said City and a point 10 feet Southerly of the center line of Lincoln Street; and in LINCOLN STREET between a point lO feet Uesterly of the center line of inyo Street and a point lO feet Easterly of the center line of Tulare Stree.t;and in TUL.&~ STREET between a point lO feet Southerly of the center line of Lincoln Street and a point lO feet. Southerly of the center line of Flower' Street; and in ~L 0~ER STREET. between a point 10 feet Easterly of the center line of Tulare Street and a point 10 feet Easter~of the center line of Kern Street; and in iGZRN STREET between a point 10 feet Southerly of the center line of Flower Street and a point 10 feet Southerly of the center line of Quincy Street; and in QUINCY STREET between a point 10 feet Easterly of the center line of Kern Street and the said Easterly City Limits line of said City. BE IT FURTiTER RESOLVED, that consent of the said City CounCil of the City of Bakersfield is hereby granted to the County of Kern having jurisdiction over the area covered by the TI.ON DISTRICTs" for such construction upon the following terms and conditions: 1. That all excavated areas within said streets shall be repaved with the same type of pavement as existed when the construc- tion v,rork is done, and all such construction including the re-paving shall at all times be ~done a.nd made to the satisfaction of the Superintendent of Streets of the said City. 2. To the commencement of the proceedings for the said proposed construction by the Board of Supervisors of said County, and to the exercise of jurisdiction by the said Board of Supervisors under all proceedings necessary or pr.oper for the purpose of consummating the same, all in accordance with the provisions of the said "Improvement _ ~' of said Streets and Highways Code of the State of .~ct of ~ 911 , C al ifornia. 3- .&ll work shall be done in accordance with Sections 7, 12 and ~6 of the Standard Specifications of the Department of Public ~orks, Division of Highways, State of California, dated .&pril, 194~. ~. .That without permission in writing.' from the SUperintendent of Streets of said City, not more than one street or alley inter- section may be closed at any one time. The contractor shall provide a water wagon for use on the v~ork and no excessive dust, in the opinion of the City Superintendent of Streets will be permitted. ~. That the County of tqern and the Panorama Sanitation District of i(ern County shall indemnify, save and hold harmless the City, its officers and employees, against and from all damages decrees, c6sts and ezp. e'nditures ~i~hich the City or such officer or employee may suffer, or v~hich may be recovered from or obtainable against the City~ or such officer or employee, proximately caused by or growing out of, or resulting from their exercise of the prosecution of the work contemplated Under this resolution of consent o .~I\vD~ BE IT FURTBXR RESOLVKD~ that the Clerk.of this City Council is hereby directed to certify and deliver a copy of this resolution to the Clerk of the Board of Supervisors of the County of Kern, o0o I E~REBY CERTIFY that the foregoing Resolution was passed and adopted by the Council of the City of Bakersfie!d~ on the !st day of November~ 1948~ by the following vote: AYES: CARNAKIS, CROSS, KUEHN, RYDER, SIEMON, VANDERLEI, VERCAM MEN NOES: _-- ~ ...........................................
