WHEREAS, the the Pacific Gas &Electric Company, a public'
utility, has applied to the City of Bakersfield for a right of
way across property belonging to said City of Bakersfield, which
right of way is more specifically described in the attached right
of way deed, and .has offered to pay to the City the~sum of Fourteen
Hundred SeVenty-five and ~0/100 Dollars ($147~.~0) therefor, and
WHEREAS, said property is not occupied by any public
building or improvement, street, highway or public park, and is
not a public place, and
WEEREAS, the grant of said right of way will not interfere
with the public use of the lands of the City traversed thereby,
and the grant thereof is for the public benefit, and
WHERE&S, the public interest will be furthered by the sale
of said right of way to the Pacific Gas & Electric Company without
advertising and without inviting or calling for bids therefor, and
WHEREAS, the amount offered by the Pacific Gas &Electric
Company for said right of way is reasonable.
NOW, THEREFORE, BE IT RESOLVED, that the Nayor and the
City Clerk be and they a. re hereby authorized to execute the attached
right of way deed on behalf of the City of Bakersfield, and to
deliver the same to the Pacific Gas &Electric Company upon receipt
of the aforementioned consideration.

I HEREBY CERTIFY that the. foregoing Resolution was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the/~ day of March, 1948, by the follow-
ing vote:
