RESOLUTION OF T~[,Z CITY COUNCIL
OF THE CITY OF BAKF~ISFIELD,
CALIFORNIA, GRANTING CONSENT TO THE
"MT. VXRNON,COUNTY SANITATION DISTRICT"
OF KERN COUNTY, CALIFORNDb TO THE
CONSTRUCTION, I~,.Z'~INTiZN~NCE ~fiqD OPEKaTION

B~,.KERSFIELD.
WHHkREAS, the Board of Directors of the "Mt. Vernon, County
Sanitation Ristrict;' of Kern County, California, has by resolution
adopted on the 27thday of October , 19h7, requested consent for the
construction, maintenance and operation of certain sewer mains to be
constructed for said district in portions of Virginia Street, Willjams
Street and Oregon Street, all within the corporate limits of the City of
Bakersfield; and,

4UHEREAS, the cost of the construction of said sewer mzins/to be
totally assessed or taxed to the lands within the said "Sanitation District"
exclusive of any lands lying within the corporate limits of said City of
Bakersfield; and
~.~HEREAS, pursuant to Section h770 of the "Sanitation District
Act" of the Health and Safety Code of the State of California, it is
necessary in order that such construction may be made within the streets
of the City of Bakersfield, that consent of the legislative body of said
City e~ressed by resolution shall be given for such construction, maintenance
and operation; and
UHEREAS, a certified copy of said resolution requesting consent
of the City of Bakersfield to the construction, maintenance and operation
of said sewer mains has been f~ed ~ith the Clerk of the City Council of the
City of Bakersfield; and
I~.iHEREAS, the City Council of the City of Bakersfield has examined
the map attached to and fo~ning a part of said resolution requesting consent,
which map shows the location and profile of such proposed construction and

is familiar with the things to be done thereunder.
NG~, TH~EFORE, BE IT RESOLVE~ by the City Council of the
City of Bakersfield, California, as follows: '
That public interest, convenience and necessity require the
location, construction and maintenance of certain sewer mains ~-dthin the
public streets of the City of Bakersfield as follows:
.(~) The construction, maintenance and operation of
a trunk line sewer in Virginia Street betv~een the
easterly boundary line of the City of Bakersfield,
southerly to the westerly prolongation of the center
line of the first alley lyLng southerly of Lake
Street, and thence easterly along said prolongation
to the easterly boundary of said City.
(b) The construction, maintenance and operation
of a trunk line sewer in Willjams Street within
the City of Bskersfield between the center line of
Pacific Street and a point distant five (~) feet
south of the center line of Oregon Street~ thence
Easterly along a line five (~) feet south of the
center line of Oregon Street to-the easterly boundary
of the City of Bakersfield, and also along the center
line of the first alley lying s'e~th of Pacific Street
and westerly prolongation thereof between the easterly
boundary line of the City of Bakersfield and ~e trunk
line sewer to be constructed in Willjams Street, as
herein described, and
BE IT FURTHER RESOLVED, that the consent of the said GAty Council
of the City of Bakersfield is hereby granted to the "Nt. Vernon,
County Sanitation District" for such construction upon the following
terms and conditions:
(1). To the construction, maintenance and operation of
the sewer mains within those certain portions of
public streets ~ithin the City of Bskersfield
as herein~DO~e described.
(2) The commencement of the proceedings for the said
proposed construction by the Board of Directors of
the "l~Tt. Vernon County Sanitation District" of Kern
County, Calif~nia, and to the exercise of juris-
diction by the said Board of Directors under all
proceed~gs necessary or proper for the purpose
of consummating the same, all in accordance ~ith the
provisions of the said "County Sanitation District
Act", Division 5 of the Health and Safety Code of
the State of California.
(3) The granting of this consent is contingent upon the
consideration of the property ovmers owning property
..... ~vithin the City of Bakersfield and fronting upon the
sewers to be constructed ~vithin the streets, under
this consent shall be permitted to mske use of such
sewers without charge to such owners or to the City
of Bakersfield, except the nominal fee for connections
to be made to any such sewers; and
BE IT FURTHER RESOLVED, that any such construction within the
streets of the City of Bakersfield shall be done and made to the satisfaction
of the Superintendent of Streets of said city~ and
BE IT FURTHF~R RESOLVED, that the Clerk of this City Council is
hereby directed to certify and deliver a copy of this. reSolu_tion to the
Secretary of the Board of Directors of the said "i~it. Vernon County Sanitation
District".
