WHEREAS, the City of Bakersfield did, by written agree-
ment dated Nay 21~ 194~, permit the Atchison~ Topeka & Santa Fe
Railway Company, a corporation, to make connections with the
Sanitary Sewer System of said City at 'the following places:
' of California ,Avenue.
The D Street Nain Sewer at 14th Street, and
WHEREAS, said agreement provides that in the event the
flow of domestic sewage in said Sewer System is of sufficient
quantity to require the full capacity of the conduit used by the
Atchison, Topeka & Santa Fe Railway Company, the City of Bakersfield
may immediately revoke said right of the .Atchison, Topeka & Santa Fe
Railway Company, by giving notice thereof, and
WHEREAS, the flow of domestic sewage in said Sewer System
is of sufficient quantity to require the full capacity of the con-
duit used by the Atchison~ Topeka & Santa Fe Railway Company by
virtue of its connection with said Sewer System at the Nyrtle Street
Nain Sewer approximately one hundred (lO0') feet north of California
.Avenue,
NOW, THEREFORE~ BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF BAKERSFIk~.D, that the permission heretofore granted the .Atchison,
Topeka & Santa Fe Railway Company to connect with the Sewer System
of the City of Bakersfield at the Nyrtle Street Nain Sewer approxi-
mately one hundred (lO0') feet north of California Avenue, be and the
same is hereby revoked, and said .Atchison, Topeka & Santa Fe Railway
Company is hereby notified to remove said connection within sixty
(60) days from the date hereof.
The City Clerk is hereby instructed to mail a certified
copy of this Resolution to each of the following:

I HEREBY CERTIFY that the foregoing Resolution was passed
and adopted by'the Council of the City of Bakersfield at a regular
meeting thereof held on the 9th day of June, 1947, by the follow-
ing vote:
