V~REAS, it is deemed to be to the best interest of the
City of Bakersfield that the facilities of the California Water
Service Company,. a public utility used and employed for develop-
ing and furnishing domestic water to'the citizens and inhabitants
of the City of Bakersfield and surrounding territory, be operated
by the City of Bakersfield as a public owned system,~
NOW, THEREFORE, BE IT RESOLVED that the.City Attorney be'
instructed to prepare a petition of the first-class, by and on
behalf of the City of Bakersfield to the Railroad Commission of
the State of California, setting forth the intention of the City
of Bakersfield to acquire the lands, properties, and rights of any
character of the California Water Service Company, a corporation,
used and employed as the public utility for Eurnishing, distribut-
ing and providing domestic water in and for the City of Bakersfield
and adjacent territory into which said public utility now extends,
by eminent domain proceedings, and asking that said Railroad Com-
mission fix the just compensation to be paid for said public utility,
all in accordance with the provisions of Section 47 of Act 6386 of
Deering's General Laws.

I HEREBY CERTIFY that the foregoing Resolution was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof, held on the 18th day of November, 1946, by the
following vote:
