HomeMy WebLinkAboutRES NO 20-46 RESOLUTION NO. 20-46 A' RESOLUTION PRESCRIBING AND DE- FINING THE DUTIES OF THE CITY .ATTORNEY OF THE CITY OF BAKERSFIELD, CALIFORNIA. WHEREAS, by virtue of the provisions of Section 39 of the Charter of the City of Bakersfield, the Council shall define the duties of appointive officers; NOW, THEREFORE, BE IT RESOLVED, that the duties of the City .Attorney be and the same are hereby prescribed and-defined, as follows: 1. To appear for and represent the City in civil actions, including the investigation of claims against the city, and pro- cee~ings for the collection of fines, taxes, and claims in favor of the City. 2. To prepare criminal complaints and prosecute violations of all City ordinances. 3. To give legal advice, in writing when requested in writing, to all legislative and administrative officers of the City. 4. To give instructions and training to City officials in the elements of public law. ~. To prepare all legal papers and documents. 6. To draft all legislative documents, charter and statutory changes, ordinances, and resolutions. To perform the legal work and assist in the acquisition of property. To perform the legal work in connection with all publi~ improvement proceedings. 9. To assist and. advise on all fiscal procedure. lO. To assist and advise the Council and the administrative and. advisory agencies of the City in the conduct of public hearings and investigations. In addition to the above, the City Attorney shall maintain his office at the City Hall and shall devote the working hours of- each working day to the service of the City. .~ It shall be the duty of the City .Attorney to attend. all meet- ings of the City CoUncil unless excused from such attendance by the Council. He-shall give his opinion upon legal questions which arise in the course of Council meetings and/or in conducting the business' of the meeting when requested to do so Iby the Council; provided, however, that the absence of such request shall not preclude his giving his opinion nor relieve him of the responsibility of advising the Council of any irregularity or lack of authority in any action being taken by the Council in his presence. It shall not be the duty of' the City .Attorney to act as counsel to the general public in relation to City ordinances and municipal functions, nor to give any opinions as to any of such matters to members of the general public; but he may furnish information as to the existence of ordinances, regulations and/or laws bearing on such matters. o0o .......
