WHEREAS, for more than fifty years Kern Island Canal Company
has owned, maintained and operated certain irrigation ditches known
as the Mill Ditch and the East Mill Ditch, lying wholly or partially
within the present city limits of the City of Bakersfield and used
to transport water for sale in public utility service for the ir-
rigation of agricultural lands; and
WHERE~,.by reason of the growth of the City of Bakersfield
most of the lands formerly served by said ditches have been converted
from agricultural to domestic, commercial or industrial uses, with
the result that there are now only a very small number of customers
still taking water from said ditches for irrigation use and said
ditches are no longer of substantial value to the areas formerly
served thereby; and
WHEREAS, the existence of said ditches is an expense and
inconvenience to the City of Bakersfield because of the necessity of
the city maintaining structures for the crossing of said ditches by
streets, sidewalks and other public facilities;
NOW9 THEREFORE, BE IT RESOLVED that it is the Judgment of
the City Council of the City of Bakersfield that it would be in the
public interest for said Mill Ditch and East Mill Ditch, excepting
only the portion of Mill Ditch lying north of 26th Street, to be
taken out of service and abandoned; and
BE IT FURTHF~RRESOLVED that the owner of said ditches, Kern
Island Canal Company, is hereby requested to discontinue the use and
operation of said ditches and to take any and all proceedings before
the Railroad Commission of the State of California for the purpose
of obtaining whatever approval or permission may be necessary for
that purpose.
I HEREBY CERTIFY that the foregoing Resolution was passed
and adopted by the Council of the City of Bakersfield at a regular
· meeting thereof held on the ~th day of August, 1946, by the follow-
ing vote:
