"~"'D~I~.~'~ the Ba:.:ersfield i.kmicipal Water District has applied
for and the Board of Supervisors of the County of iCern has levied
a tax of ten (10~) cents on each One Hundred (~.~100.00) Dol].ar
valuation of all the property in the district~ which includes
practically all of the City of Bakersfield~ and
~,~]~R~S~ the people of the City of Bakersfield v~ill be thus
compelled' directly . ~ .
mn ~ to Day for divers ~nd sundry activities of
the Board of Directors of said District~ which may or may not be
designed to secure public ov~nership and control of domestic water
distribution facilities~ without having been allowed to express
their desires for public acquisition and operation of the vfater
district facilities~ and prior to the time v~hen they can be given
an opportunity to express such desire; and
%~i~S~ such levy upon the property of the .people of the
City of Bal~ersfie].d' constitutes taxation without representation~
and imposes an unnecessary and v~holly unjustifiable burden upon the
people of the City~
NOW~ TI-~REFOI~E~ be it resolved:
1. That the City of Bakersfield renounces and repudiates any
responsibility for or connection with the proposed levy on behalf
of said. Lfunicipa3. Water District;
2. That in the opinion of the City Council, said levy places
an umecessary and un~ustifiable burden upon the property of the
~eople of the City;
3. That said BaYKersfield iYmicipal 'jfater District does not
in any mamer represent or speak for the City of Bakersfield;
4. That said Bat~ersfieid Liunicipal Water District has been
revived after having been allo~ved to lie dormant for nearly tv~enty
years, and v~ithout any public demand therefor;
~. That the City of Bakersfield is proceeding according to

provisions of its Charter to determine uhether the people desire
to acquire the water distribution service, of.the City~ and that by
such means the will of the people will be secured before and without
the necessity of any tax levy or the expenditure of any money~
6. That the CounCil therefore believes that said tax levy
is wholly unnecessary and ill-advised and that there is no legal
justification thereforei and
?. That the City Attorney and the City Manager bey and they
are hereby instructed to investigate the legality of such tax~
the possibility and probability of preventing its collection~ and
to proceed in any manner which may be provided by law, to prevent
the imposition~ levy and collection of said tax.
