HomeMy WebLinkAboutRES NO 10-42 ';~PD]:{)iAS, on or about the 28th day of September, 1942, a Resolution was ~uly and regularly adopted by the unanimous vote of the members of the City Council of the City of Bakersfield~ A~.jD 'I../i~..i~S, saic] Resolution is officially designated as Resolution Number 6~ of the City of BskersfielcN, a municipal corporation~ and reference is hereby made thereto~ and sai~ Reso- lution is hereby incorporated herein~ A~ WI-DZ~Hi]~S~ in s~i~ Resolution the [Cetals Reserve Company, a subsidiary of the Recon. struction Finance Corporation, an agency of the United States, ~.vas given permission to remove from the streets of the City of Bakersfield certain rails~ track fastenings, and other metallic track material located in ssi~] streets and ovfned by the Bakersfield & Xern Electric Railway ComFany~ a corporation, ~D '.,i-kLii~.~8~ in said Resolution it was further provided that any wori..: required to ren~ove said materials and to place the streets of saiC City from ';.~hicl, they may be removed in proper and satisfactory condition thereafter should be done in accordance with specifications to be prepared and approved by the City Engineer and Superintendent of Streets of said City, and that no damage to any such streets would be claimed by the .City of Bakersfield providing the Metals Reserve Company shoul~ perform such worth in accordance with said specifications and conditions~ ~i']'D ',;i[,.,~6_,~[i, the Bakersfield 6: Kern Electric Rail~.:.,'ay Comi:,any has agreed that sai~ materials may be used in accordance with the desires and instructions of the War Production Board to further the war effort~ without r~ore than a nominal consideration to the Bakers- field g.~ Kern Electric Railv~ay Company, Al'.~ L~LEZ~'~ it is deemed by the Council of the City of Bakersfield that ssiCt -~Bab. ersfield & Kern Electric Railway Company shoul~ be relieved from financial responsibility by reason of the -1- ren~oval of said materials and the repair of any streets from which they may be removed~ i,Y01';~ T~',r[}i']i~;0R]~ IT I~ RESOL~V.D that the Bakersfield and Kern Electric Railway Company is hereby relieved from any and all obliga- tions to repair the streets from which said rails or other metallic materials may be removed in accordance with the 'provisions of Resolu- tion Number 6~ of the Council of the City of Balc. ersfield~ above referred to, o0o - I KE:PJ,]BY CERTI~'Y that the foregoing Resolution was passed and adopted by the Council of ti:,e City of Bakersfield~ at a regulsr meeting thereof held. on the/ a of 0ctober~ 1942~ by the follow- __dy ing vote: AYES: CLEMENTS, MARMADUKE, NORRIS, SIEMON, SMITH, VANDERLEI, VERCAMMEN NOES: _~ .................................................
