HomeMy WebLinkAboutRES NO 18-41RESOLUTION NO. ]~8~41 A RESOLUTION AUTHORIZING THE CITY MANAGER AND OTHER OFFICERS AND EMPLOYEES OF THE CITY OF BAKERSFIELD TO COLLECT DATA RELATIVE TO THE PUBLIC UTILITY WATER QUESTION. WHEREAS, qualified electors equal in number to not less than thirty-five percentum of the votes cast at the last munici- pal election at which all qualified registered electors were en- titled to vote have petitioned the Council of the City of Bakers- field to submit, by ordinance, to the qualified electors of the City, at any special election at which all qualified electors are entitled to vote, a plan for the acquisition of the public utility of the California Water Service Company for the furnishing and supply of domestic water, AND WHEREAS, the Charter of the City of Bakersfield provides that before submitting any plan for the construction and establish- ment of a public utility the Council shall cause an estimate to be made and the cost to be ascertained at which such public utility can be constructed or acquired; AND WHEREAS, the Council will be unable to submit any plan for the acquisition of such public utility without having first obtained an estimate of the sum for which said utility may be purchased on a voluntary sale or on condemnation, or otherwise; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF BAKERSFIELD that the City Manager ascertain for the Council the cost at which such public utility can be constructed or acquired, and that to such end he solicit an offer by and ascertain from the California Water Service Company the price at which it would be willing to sell its system in the City, and adjacent territory to the City, and that the City Manager, with the aid of such other -1- officers and employees of the City as he may deem necessary, pro- ceed also to prepare, draw up and formulate data from which may be ascertained and made an estimate of the cost at which such public utility company can be constructed or acquired, in any manner according to law, and that in the collection of such data the City Manager, and such other officers and employees of the City as he may deem necessary, are hereby authorized to consult with the members and the employees of the Railroad Commission of the State of California, and/or with the officers and employees of other cities of this state, as may be deemed necessary by the Manager. ........... o0o I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on the/~day of November, 1941, by the following vote: RYES, CLF.!*tENTS, MRRMR!)UKE, Ft, ORRIS, SIEIV~ON, ~,M II I~, 50LLERS, VV.
