A RESOLUTION REQUESTING THE FILING OF
PROPER APPLICATION BY THE PACIFIC GAS
AND ELECTRIC CONPANY FOR BOTH GAS AND
ELECTRIC FRANCHISES.
NO. 5-41
WHEREAS, a purported application. by the PACIFIC GAS AND
ELECTRIC COMPANY was filed with the City Clerk on April 4, 1941,
which is unsigned and unexecuted by any officer of the Company
and wholly unauthenticated; and,
WHEREAS, the application is not in conformity with the
memorandum proposal of the Company dated September 27, 1939, and
signed by W. E. Durfey, in that it does not propose an abandon-
ment of existing so-called "Complementary Franchises" and is
ambiguous in certain respects;
NOW, TPREREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF BAKERSFIELD, as follows: That the Company be requested to file
formal executed application pursuant to said. memorandum for both
gas and electric franchises under the "Franchise Act of 1937",
without attempting therein to define or limit the franchises, but
complying with the requirements of Section 2 of said Act; and that
further proceedings on the purported application. filed April 4, 1941,
be deferred for a reasonable time to determine if compliance with
this resolution may be secured;
AND, further, that a copy of this resolution be transmitted
to the PACIFIC GAS AND ELECTRIC COMPANY.

I HEREBY CERTIFY that the foregoing Resolution was passed
and adopted by the Council of the City of Bakersfield, at a regular
meeting thereof held on the 28th day of April, 1941, by the follow-
ing vote:
