AN E~IERGENCY RESOLUTION WAIVING PROVISIONS FOR
LIQUIDATING DAI~AGES TO THE EXTENT OF THE ADDI-
TIONAL TII~E REQUESTED FOR COM~LETION OF CONTRACT
UNDER P.W.A. DOCKET N0. CALIF. 1892-F
WHEREAS the immediate preservation of the public eace,
property, safety,'health and welfare of the inhabitants of t~ City
of Bakersfield require the passage of an emergency resolution waiving
the provision for liquidated damages as provided in Paragraph (e),
Sectmon 8, General Conditions, page 20 of the Specifications and
Contract for Contract No. 8, Additions to Sewage Treatment Plant,
P.W.A. Docket No. Calif. 1892-F, to the extent of fourteen (14) calen-
dar days' additional time requested to complete said contract, said
emergency existing due to the short period offtime remaining for the
completion of said contract,
ANDWHEREAS, said extension of time of fourteen (14) addi-
tional calendar days, as requested for the completion of said contract
is made necessary because of working days lost due to the inability
of equipment manufacturers to deliver their products to the job site
at the a pointed time; to labor strikes and walkouts to changes in
design o~ buildings and equipment after ;
construction had started, all
of which were unforeseen when the time of completion was first deter-
mined, and through no fault of the contractor,
AND WHEREAS, the City of Bakersfield has made a request that
an extension o~ fourteen (14) additional calendar days be granted to
the contractor for the completion of said contract,
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF BAKERSFIELD, as follows:
That the City of Bakersfield hereby waives the provision
for liquidated damages provided in said Contract for Contract No. 8,
Additions to Sewage Treatment Plant, P.W.A. Docket No. Calif. 1892-F,
to the extent of the additional fourteen (14) calendar days requested
for the completion of said contract.
This resolution shall take effect from and after its
passage and approval.

I HEREBY CERTIFY that the foregoing Emergency Resolution
was passed and adopted by the Council of the City of Bakersfield at
a regular meeting thereof held on the 28th day of February, 1940, by
the following vote:
