HomeMy WebLinkAboutRES NO 62-39 EMERGENCY RESOLUTION NO. 62-39 AN EMERGENCY RESOLUTION A~iENDING A RESOLUTION PASSED BY THE COUNCIL OF THE CITY OF BAKERSFIELD ON THE BOTH DAY OF OCTOBER, 1939 ENTITLED: "A RESOLUTION ACCEPTING THE 0FFE~ OF THE UNITED STATES TO THE CITY OF BAKERSFIELD TO AID BY WAY OF GRANT IN FINANCING THE CONSTRUCTION OF ADDI- TIONS TO THE SEWAGE TREATENT PLANT, BkKERSFIELD, CALIFORNIA." WHEREAS, a resolution was passed by the Council of the City of Bakersfield on the BOth day of October, 19B9, entitled: "A RESOLU- TION ACCEFfING THE OFFER OF THE U~]'ITED STATES TO THE CITY OF BAKERS- FIELD TO AID BY WAY OF GRANT IN' FINANCING THE CONSTRUCTION OF ADDI- TIONS TO THE SEWAGF~ TREATMENT PLA~, BAEER~FIELD, CALIFORNIA", AND WHEREAS, it was the intention of the Council that said Resolution be passed as an Emergency Resolution, but by oversight the emergency feature of the same was omitt'ed, NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF BAKERSFIELD that said Resolution passed by the Council of the City of Bakersfield on the BOth day of October, 19B9, and entitled "A RESOLUTION ACCE~TING THE OFFER OF THE UNITED STATES TO THE CITY OF BAKERSFIELD TO AID BY WAY OF GRANT IN FINANCING THE CONSTRUCTION OF ADDITIONS TO THE SEWAGE TREATMENT PLAR~, BAKERSFIELD, CALIFORNIA" be and the same is hereby amended to read as follows: EMERGENCY RESOLUTION AN EMERGENCY RESOLUTION ACCEPTING THE OFFER OF THE UNITED STATES TO THE CITY OF BAKE~SFIELD TO AID BY WAY OF GRANT IN FINANCING THE CONSTRUCTION 0FADDITIONS TO THE, S~/~AGE TREATMENT PLANT, BAKERS- FIELD, CALIFORNIA. WHEREAS, the immediate preservation of the public peace, property, safety and welfare of the inhabitants of the City of Bakersfield require the passage of an emergency resolution providing for the immediate acceptance of the Amendstory Offer of the United States of America to the City of Bakersfield, a municipal corporation, to aid byway of grant in financing the construction of additions to the Sewage Treatment Plant~ Bakersfield, California, -1- AND WHEREAS said emergency exists in that.it is necessary for the said City of Bakersfield'to accept said amendatory offer immediately in order that the work of construction of said Sewage Treatment Plant be completed by January 16, 1940, NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF Th~ CITY OF BAKERSFIELD, as follows: 1. That the Offer of the United States of America to the City of Bakersfield, California, to aid byway of Grant in financing the construction of additions to the Sewage Treatment Plant, a copy of which Offer reads as follows, be and the same is hereby in all respects accepted: FEDERAL WORKS AGENCY Public Works Administration Washington, D. C., Dated: Oct. 23, 1939 Docket No. Calif. 1892-F City of Bakersfield Bakersfield, California The United States of America hereby offers to amend the contract created by the acceptance by the City of Bakersfield, California, on October 17, 19~8, of the Offer made by the United States of America and dated October 13, 1938~ (1) by striking out, in lines 3, 4 and 5 of Paragraph I of said Offer, the words "construction of a sewage disposal plant and of extensions to a sewer system, including nec- essary laboratory equipment and the acquisition of necessary land and rights of way" and inserting in lieu thereof the words "construc- tion of a sewage treatment plant and of extensions to a sewer system including necessary laboratory equipment and site improvements"; (21 s~riking out, in line 9 of said Paragraph i the figures "$~0,949" and inserting in lieu thereof the figures "~96,349"; and (~ striking Gut Paragraph 2 of said Offer and inserting in lieu thereof a para- graph to read as follows: "2. By acceptance of this Offer the dispatch, ' UNITED STATES OF AMERICA Federal WOrks Administrator By (SiNned) E. N. Clark Acting Commissioner of Public Works. -2- 2. That said City of Bakersfield agrees to abide by all the terms and conditions of said Offer, including Te~ms and Condi- tions annexed thereto and made a part thereof. 3- That the City of Bakersfield be and is hereby authorized and directed forthwith to send to the Federal Works ~gency, P~blic Works Administration, three (3) certified copies of the proceedings of the City Council of the City of Bakersfield in connection with adoption of this Emergency Resolution, setting forth this Emergency Resolution in full, and such further documents as proofs in connection with the acceptance of said Offer as may be requested by the Public Works Administration. 4.
