WEEAS, the immediate preservation of the public peace, prop-
erty, safety, health and welfare of the inhabitants of the City of
Bakersfield'require the passage of an emergency resolution waiving
the provision for liquidated damaEes as provided in Paragraph (e),
Section 5, General ConditionS, pa~e 20 of the Specifications and
.Contract for Contract No. 3, Sewage Treatment Plant, P.W.A. Docket
No.'Calif. 1892-F, tothe extent of Sixty (60)' calendar days addi-
tional time requested to complete said contract, said emergency
existing due to the short period of time' remaining for the comple-
tion of said contract,
AND YjT~]REAS, said extension of time' of sixty (60) additional.
calendar days, as requested for the .completion of said .contract is
made necessary because of working days lost due (1) to the inability
of equipment manufacturers to deliver thei.r'products to the job site
at' the appointed time; (2) to labor Strikes. and walkouts; (3) to
changes in design of buildings and equipment after construction had
started, all of which were maforeseen when the time of completion
was first determined, and through no'fault of the contractor.
AND YyTEEAS, the City of Bakersfield has made a request that an
extension of sixty (60) additional calendar days be granted to the
contractor for the'completion Of said contract~
NO'j4 Ti-D~.XEFORE, BE IT RESOLVED BY Th~ COUiqCIL OF T~NE .CI~3Z OF
BAEZ-]SFiELD, as follows:
That the City of Bakersfield hereby waives the provision for
liquidated damages provided in said Contract for Contract iTo, ~,
Sewage Treatment Plant, P.]V.A. Docket No..Calif. 189~-F, to the
extent of the additional sixty (80) calendar days requested for
the completion Of said contract.
This resolution shall take effect from and after it's passage
approval.
I'KEREBY CERTIFY that the foregoing ~uergency Resolution was
passed and'adopted by the Council of the City of Bakersfield at a
regular meeting thereof held On the / ~day of June 1939 by the
