NO. 17-39 The immediate preservation of the.public peace, safety and welfare of the inhabitants of the City of Bakersfield require the passage of an emergency resolution, as follows: ~KEREAS, it is believed to be advantageous to resurface the pavement on Chester Avenue between 8th Street and 19th Street, which will result in raising the grade thereof approximately two inches above the rails of the Bakersfield and Kern Electric Rail- way Company on said portion of Chester Avenue, AND WHEREAS the Bakersfield and Kern Electric Railway Company has declared its intention to abandon its South Chester Avenue railway line upon obtaining the necessary authority of the Railroad Commission of the State of California and has further declared its intention to establish as a substitute for Such South Chester Avenue line an automobile passenger bus service to serve said territory as.well as additional territory,' NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF BAKERSFIELD that it does hereby approve the discontinuance of the service upon and the permanent abandonment of the Bakersfield and Kern Electric Railway Company of its South Chester Avenue electric street railway line, Consisting of a double track on Chester Avenue from 19th Street south to llth Street,'a single track on llth Street between Chester Avenue and P Street, a single track on P Street from llth Street to 8th Street, a single track on 8th Street to Chester Avenue, and a single track on Chester Avenue from 8th street to llth Street, together with the necessary poles and overhead trolley system, on the following terms and conditions: 1. That upon the request of the Bakersfield and Kern Electric Railway Company and its discontinuance of service upon and the abandonment of said South Chester Avenue line, the City of Bakers- -l- field will at its own cost remove the rails and tie~ of~the Bakers- field and Kern Electric Railway Company constituting the track on llth Street, P Street and 8th Street, in consideration of the said Bakersfield and Kern Electric Railway Company abandoning and turning over to the City of Bakersfield all of its rails and ties in said proposed portion of said railway to be abandoned, if and when the same shall be abandoned. 2. Said railway company shall remove at its own expense all of the poles and wires constituting the overhead trolley system of said South Chester Avenue line, provided that it shall not remove any poles of such overhead trolley system to which the facilities of other utilities of the City of Bakersfield are attached, and where said poles are located in concrete sidewalks or in pavement such poles shall be removed to a depth of eight inches below the sidewalk elevation and the sidewalk square in which the pole was located shall be removed and repaired to the satisfaction of the City Engineer, and shall pay to the City of Bakersfield on or before the 18th day of July, 1939, the sum of $1,982.41 as its portion of covering said tracks. Should said sumbe not paid or any of the conditions of this resolu- tion be not carried out on or before the 15th day of July, 1939, then this resolution shall be void.
