AN EMERGENCY RESOLUTION AlfENDING CHANGE ORDER N0. 2,
CONTRACT NO. 2, TO WAIVE PROVISIONS FOR LIQUIDATED
DA~EAGES TO TEE EXTENT OF TEE ADDITIONAL TIE REQUEST-
ED FOR C0}~LETION OF CONTRACT NO. 2 UNDER P.W.A.
DOCKET NO. CALIF. 1892-F
WHEREAS, the immediate preservation of the public peace,
property, safety, health and welfare of the inhabitants of the
City of Bakersfield require the amendment of Change Order No. g,
Contract No. 2, waiving the provision for liquidated damages as
provided in paragraph (e), Section 5, General Conditions, page
20 of Specifications and Contract for Contract No..2, Sewage
Pumping Station, P.W.A. Docket No. Calif. 1892-F to the extent
of fifteen (15) working days, excluding Sundays and Holidays,
additional time requested to complete said contract. Said emer-
gency existing due to the short period of time remaining for the
completion of said contract.
AND WHEREAS, said extension of fifteen (15) additional
working days, excluding Sundays and Holidays, as requested for
the completion of said contract is made necessary because of the
changes listed and provision called for in Change Order No. 2,
Contract No. 2, Sewage Pumping Station, P.W.A. Docket No. Calif.
1892-F.
AND WHEREAS, the City of Bakersfield has made a request
that an extension of fifteen (15) additional working days, ex-
cluding Sundays and Holidays, be granted to the Contractor for
the completion of said contract,
NOW THEREFORE, be it resolved by the Council of the
City of Bakersfield, as follows.:
That the City of Bakersfield hereby amends Chsnge
Order No. 2, Contract No. 2, and waives the provision for
liquidated damages provided in said Contract No. Z, Sewage
Pumping Station, P.W.A. Docket No. Calif. 1892-F to the ex-
tent of the additional fifteen (18) working days, excluding
Sundays and Holids~s, requested for the completion of said
Contract.
This resolution shall take effect from and after
its passage and approval.
I hereby certify that the foregoing Emergency Resolu-
tion was passed and adopted by the Council of the City of Bskers-
field at a regular meeting thereof held on the ~7~J~day of
