WHEREAS, the City of Bakersfield is a municipal corpora-
tion organized and existing under and by virtue of the laws of the
State of California; and,
~THEREAS, said City has a population of approximately forty
thousand; and,
WHEREAS, a large portion of the area of said City might be
over-flowed from Kern River during times of high water; and,
WHEREAS it would be desirable to have some form of flood
control;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF BAKERSFIELD, as follows:
That the said City of Bakersfield will cooperate with the
Secretary of War in connection with the investigation of a project
for the control of floods on the Kern River in the County of Kern,
State of California; that if and when such a project is authorized
by an act or acts of Congress of the United States in accordance
with the recommendations of the Secretary of War, and if such project
includes provisions for the control of flood waters which are satis-
factory to said City and is deemed sufficiently advantageous to said
City to incur the necessary expenditures, then the Council of the
City of Bakersfield will use its best endeavors to take and complete
any and all'steps and proceedings within its legal power which may
be necessary in order that it may join with others benefited there-
by in sponsoring those portions of such project which specifically
provide for flood control;
That the said City of Bakersfield will use its best endeavors
to take and complete any and all further steps and proceedings which
may be necessary in order that said City may give assurance satisfactory
to the Secretary of War of its intention to act within its legal auth-
ority so that it may fulfil any obligations which it may undertake in

connection therewith, including the obligations as follows:
(a) To contribute a proper ratable portion
in proportion to the benefits received of
the funds which may be necessary to provide
for said flood control;
(b) To cooperate in providing lands, ease-
ments and rights of way necessary for con-
struction of an adequate dam or other flood
control facilities;
(c) To join with others benefited by the pro-
Ject in holding and saving the United States
free from damages in the construction of works
designed for the control of flood water.
(d) To join with others benefited by the pro-
Ject in maintaining and operating the works
relating to flood control after the completion
of said works in accordance with the regulations
prescribed by the Secretary of War and that may
be satisfactory to the Council of the City of
Bakersfield and in accordance with the laws
governing said City.
BE IT FURTHER RESOLVED that the Clerk of the Council of the
City of Bakersfield is hereby authorized and directed to forward certi-
fled copies of this resolution to the District Engineer, United States
Engtneer's Office, 208 P.O. Building, Sacramento, California.
