AN Eh,~ERGENCY RESOLUTION WAIVING PROVISIONS
FOR LIQUIDATED DAMAGES TO THE EXTENT OF THE
ADDITIONAL TINE REQUESTED FOR COI~LETION OF
CONTRACT UNDER P.W.A. DOCKET N0. CALIF.1892-F.
WHEREAS, the immediate preservation of the public peace,
property, safety, health and welfare of the inhabitants of the
City of Bakersfield require the passage of an emergency resolu-
tion waiving the provision for liquidated damages as provided in
Paragraph (e), Section 8, General Conditions, page 20 of, Specifica-
tions and Contract for Contract No. 2, Sewage Pumping Station,
P.W.A. Docket No. Calif. 1892-F, to the extent of the thirty (30)
working days additional time requested to complete said contract,
said emergency existing due to the short period of time remaining
for the completion of said contract,
AND WHEREAS said extension of time of thirty (30) addi_
tichal working days, excluding Sundsys and Holidays, as requested
for the completion of said contract is made necessary because of
working days lost due to inclement weather and adverse working con-
ditions unforeseen when the time of completion was first determined,
and through no fault of the contractor,
AND WHEREAS the City of Bakersfield has made a request
that an extension of thirty (30) additional working days, excluding
Sundays and Holidays, be granted to the contractor for the comple-
tion of said contract,
NOW, TEEFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF BAKERSFIELD, as follows:

That the City of Bskersfield hereby waiVeS the provision
for liquidated damages provided in said contract for Contract No. 2,
Sewage Pumping Station, P.W.A. Docket No. Calif. 1892-F, to the ex-
tent of the additional thirty (SO) working days, excluding Sundays and
Holidays, requested for the completion of said contract.
This resolution shall take effect from and after its
passage and approval.

I HEREBY CERTIFY that the foregoing Emergency Resolution
was passed and adopted by the Council of the City of Bakersfield
at a regular meeting thereof held on the 27th day of February,
19S9, by the following vote:
