WHEREAS, Pursuant to the provisions of the IMPROVEMENT BOI~D ACT of 1915, the Street Superintendent of the City of Bak- ersfield, California, did on the 13th day of July~ 1925, file with the City Clerk of said City a complete list of unpaid assess- ments remaining unpaid upon the assessment for the improvement of Twenty-fourth Street~ in said City, as per Resolution of Inten- tion 503, adopted by the Council of said City on the 27th day of October, 193~.o, and included in said list of unpaid assessments were assessments Numbers 12, 16, 17, 18, 3.0, 31, 33, 34, 95 and 96 j and, WEERFAS~ subsequent to the filing on July 13, 192~, of said list of unpaid assessments certain property ovmers or parties~ in interest have paid to the City Treasurer and/or to the Superintend- ent of Streets of the said City the full principal amount of said assessments, Numbers 12, 16~,, 17, 18, 30, 31, 33, 3~-, 95 and 96, together with interest thereon, aggregating the total sum of $ 5,039.57 ana WHEREAS, on or about the 1st day of April~ 1936, the Street SUperintendent of said City disbursed and paid to the Union Paving Company, the ovmer and holder of the lien of the above mentioned assessment numbers, the sum of Two Hundred Thirty-Eight and 73/100 ($238.73), theretofore Collected by him, being a portion of the lien created by the above mentioned Assessment No.12, leaving a balance in the Trust Fund in the Office of t_he City Treasurer of said City of the sum of $4,800.84~ AND, WHEREAS, the said City Treasurer from time to time made deposits of certain of said monies collected by him in the banks of the City of Bakersfield and the interest accrued to date upon such bank deposits is the sum of NOW, THERFFORE~ b9 it resolvedby the Council of the. City of Bakersfield as follows: (a) That the City Treasurer of the City of Bakersfield be, and he is~ hereby authorized and directed to disburse and pay to the UNION PAVING COMPANY the sum of $4~800.84~ as represent- ing all monies collected and held in trust for the benefit of said Union Paving Company, by the said City Treasurer~ on account of the lien created byAssessments Numbers 12, 16, 17, 18, 30, 31, 33 34~ 95:and 96, upon receip~ from the said UNION PAVING COMPANY of releases in full and authorizing the Street Superintendent of the City of Bakersfield to cancel and satisfy the lien of said assessments in full upon the record on file in his office. (b) That the Auditor of the City of Bakersfield be~ and he is~ hereby authorized and directed to draw his warrant in favor of the UNION PAVING COMPANY for the sum of sixteen hundred and forty-six dollars ($1646.00)~ payable out of the general fund, representing the amount of interest on bank deposits of the sum of money hereinabove in Paragraph (a) specified~ and the said City Treasurer is hereby authorized and directed to pay said warrant at the same time that he makes the disbursement of said sum of $4800.8~. ..... o0o .....
