V~TEEAS the Bakersfield School District is desirous
of const~cting a pedestrian underpass under Emergency Relief
Administration designated as Project No. 1V-Bl-llB, from the
Fremont School under United States Hi~way Number 99 in the City
of Bakersfield,
AND ~EEAS, said Bakersfield School District desires
to procure the consent of the City of Bakersfield for such construc-
tion,
AND WHEEAS the Bakersfield School District agrees to
assume all of the obligations for the const~ction and maintenance
of the same, and to save the City-of Bakersfield hapless from any
claims, demands, liabilities, d~ages or losses of any kind or
nature arising out of or by reason of the construction and main-
tenance of said underpass,
NOW, TEE~0E, in consideration of the foregoing recitals
and the agreement on the part of the Bakersfield School District to
keep and perfo~ all of the foregoing conditions on its part to be
kept and perfoxed, the City of Bakersfield does hereby give, so far
as is within its power so to do, a permit to construct said underpass,
according to the plans and specifications adopted under and by virtue
of said Project No. 17-Bl-ll~, reserving unto itself, however, the
ri~t to keep, maintain, erect and construct all necessary sewers
and public improvements upon said United States Highway No.

has caused these presents to be duly executed by its duly authorized
