HomeMy WebLinkAboutRES NO 01-32IN RE STATE HIGHWAY DESIGNATED AS ROAD VI-KER-4-G RESOLUTION CONSENTING TO SECURE RELEASES OF POSSIBLE CLAI!.4S AGAINST THE STATE OF CALIFORNIA. NO. 1-32 WHEREAS, the California Highway Commission did, on the 28th day of Nay, 1931, adopt, layout, and designate a State high- way extending through the City of Bakersfield from Union Avenue northwesterly, on the westerly side of and parallel to the Southern Pacific Railroad, to the northerly city limits of the City o~Bakersfield, said State highway so adopted, layed out, and designated forming a part of the so-called Union Avenue to Oil Tank Farm Project, on Road VI-Ker-4-G, and designated as Golden State Avenue in the proceedings of Acquisition and Improvement District No. 3, of the County of Kern, State of California; and V~EREAS, the Department of Public Works of the State of California, acting by and through the Division of Highways, proposes to construct said State highway through said City of Bakersfield on the routing hereinbefore referred to, and WHEREAS, it appears that the plans and specifications for the construction of said State highway will require, at certain locations, the construction of said State highway at a grade lower, and at certain locations at a grade higher, than the present grade of the existing intersecting city streets; and WHEREAS, the understanding and agreement heretofore had between the City of Bakersfield, the County of Kern, and the State of California, acting by and throu~ the Department of Public Works and the California Highway Commission, contem- plates that all right of way necessary for the construction of said State highway shall be furnished the State of ~alifornia without cost or expense to said State; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Bakersfield that, in consideration of the construc- tion of said highway by the State of California, the City of Bakersfield agree to and said City of Bakersfield does hereby agree to indemnify and save harmless said State of California, the Department of Public Works of said State, its officers, agents, and employees, from all and all manner of action or actions, cause or causes of action, suits, damages, trespasses, claims or demands whatsoever on the part of any property ovmer or other person for or by reason of the location, establishment, or construction within said City of said State highway herein- before referred to; and BE IT FURTHER RESOLVED, that the grades for said \ State highway, Road VI-Kern-4-G Through Bakersfield, (Golden State Avenue) as shown on the layout plan and profile for said highway, on file in the office of the City Clerk of the City of Bakersfield, be and the same are hereby approved and said City Council hereby pledges itself to cause to be prepared and to adopt such ordinances as may be necessary to officially adopt said grades as the official grades for said Golden State Avenue and in like manner to re-establish the grades for all intersecting City Streets so that the same will conform thereto.
