ANY CLAIM AND DENAND TPD~T THE CITY OF
BAKER FIELD MAY HAVE AGAINST D. W. STIL-
WELL, THE FOREMER CITY TREASURER OF THE
CITY OF BAKERSFIELD, UNTO THE ~qARYLAND
CASUALTY. COMPANY, A CORPOR_~TION.

~"~IEREAS, the Maryland Casualty Company, a Corporation,
were the surety for the faithful performance of the duties of
D. '~. Stilwell, the former City Treasurer of the City of Bakers-
field;
AND VfitEREAS, the ~aryland Casualty Company have paid to
the City of Bakersfield the sum of: fourteen thousand nine hundred
and ninety-nine dollars and ninety-eight cents (~14,999.98) for
all losses sustained by the City of Bakersfield because of the
loss and shortage in the money handled by the said City Treasurer;
AND VfitEREAS, the Maryland Casualty Company have prepared
and desire the execution of an assignment wherein and whereby the
City of Bakersfield shall assign to the Maryland Casualty Company
any claim and demand that the City of Bakersfield may have against
the said D. W. Stilwell on account of, and arising by reason of
the loss and shortage in the money handled by the said City Treasurer;
NOW THEREFORE, it is unanimously resolved by the City
Council of the City of Bakersfield that the Mayor and City Clerk
are hereby expressly authorized to execute and deliver to the Iviary-
land Casualty Company, the surety for the said D. W. Stilwell,
an assignment of account, claim and demand against D. W. Stilwell,
the former City Treasurer of the City of Bakersfield, wherein said
assignment transfers and assigns unto the said Maryland Casualty
Company all of the right, title and interest, claim and demand that
the City of Bakersfield has or might recoup or otherwise claim
against the said D. W. Stilwell because of or by reason of the loss
and shortage in the money handled by the said D. !'V. Stilwell, former
City Treasurer of the City of Bakersfie.ld, ~esting title in and to
every claim and demand of any kindSwhatsoever arising by reason of
such shortage in and to the Maryland Casualty Compahy, a Corpora-
tion, authorizing the said Naryland Casualty Company in its own
name to sue for and recover and take any and all legal steps or
proceedings necessary or that might be deemed proper to obtain
judgement against the said D. W. Stil~vell, the former City Treas-
urer of the City of Bakersfield.

I HEREBY CERTIFY that the foregoing Resolution was regu-
larly passed and adopted by the Council of the City of Bakersfield,
on the/ ... ay of May, 1928, by the following vote:
