A RESOLUTION ACCEPTING AND ORDERING THE
RECORDATION OF TItAT CERTAIN DEED, -~
DAT~'ID OCTOBER llTH, 1928, V~tEREBY THE
SOUTHER PACIFIC RAILROAD COMPANY GRANTS
UNTO THE CITY OF BAKERSFIELD, THE RIGHT
TO CONSTRUCT AND MAINTAIN A HIGPF~VAY UPON
AND. ACROSS CERTAIN REAL PROPERTY.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF BAKERS-
FIELD, as follows:
That that certain grant contained in that certain Deed,
dated October llth, 1926, wherein the SOUTHERN PECIFIC RAILROAD
COMPANY_, a corporation, grants unto the CITY OF BAKERSFIELD, a
municipal corporation, the right to construct and maintain a ~i~h-
way upon and across that certain parcel of land situated in and
lying within the railroad right of way of Southern Pacific Rail-
road Company, and described as follows, to-wit:
Commencing at the southeast corner of the southwest
quarter of Section 28, Township 29 South, Range 28
East, Mount Diablo Base and Meridian; thence South
89° ~' West along the south line of said legal sub-
division a distance of 581.12 feet to an intersection
with the easterly line of the Southern Pacific Rail-
road Company's lO0 foot right of way through said
legal subdivision and point of beginning of ~arcel
of land being described; thence North 18° ~9! ~0" East
along last described line a distance of 80.~2 feet to
a point; thence South 89° 4~' West parallel and 57.75
feet measured at right angles northerly from said south
line of said legal subdivision a distance of 104.45 feet
to an intersection with the westerly line of said rail-
road company~s said lO0 foot right of way; thence South
16° 29~ ~0" West along last described line a distance
of 60.~2 feet to an.intersection with said south line
of said legal subdivision; thence North 89° 4~' East
along last described line a distance of 104.45 feet
more or less to point of beginning, and containing an
area of 0.1~848 of an acre of land more or less.
Above described parcel of land being a portion of said
southwest quarter of Section 28.
Be and ~he same is hereby accepted.
BE IT FURTHER RESOLVED that the City Clerk is hereby
directed to cause said deed, as heretofore mentioned, to be re-
corded in the office of the County Recorder of Kern County, Cal-
ifornia.
I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield on
the //~/A day of October, 1926, by the following vote:
