Resolution authorizing the City Attorney
to take such action or proceeding, Necessary
to recover the amount expended fo~, the
performance of the Agreement of Laz l~ontoya
WHERe'.AS, THE City of Bakersfield and Laz iviontoya
did on the 5th day of July, 192'~ enter into an agreement wherein
it was provided that said Laz }~'~ontoya agreed to keep the said
City Dump Yard in a clean and sanitary condition,
AF.D ~.-~iHFREAS, said Laz }~ontoya has failed, refused and
neglected to keep or place said City Dump Yard in a clean and
sanitary condition,
AND If~HEREAS, said Laz ~!ontoya did on the 18th day of July
1921, enter into a bond or undertaking with R. I~cDonald, R.
McDonald Jr., J. E. Caldweli and Jinxes E. Bolender as sureties
for the faithful performance of the conditions and coven~ts
as in said contract provided, :..
AND ~HEREAS the oity of Bakersfield hasb~a;h compiled to
expend the s~ of eight hundred twenty-six dollars and twenty cents
(~826.20) in the perform~ce of the duties agreed to be performed
by Laz. ~Jontoya,
AND m~IEREAS, demand has been made for this ~ount upon
the sureties in said. undertaki~
NOW TH~;'~EF0;~E BE IT RESOLVED that the Oity Attorney be
authorized and directed to take such. action or proceeding as
shall be necessary to cause said eureties to pay said City the
~ount expended by the City.
i HEREBY CERTIFZ that the foregoing Resolution was passed
and adopted by the Council of the oity of Bakcrsfield on the Z~
day of tugust, 1922, by the followin~ vote:
