ROLL CALL Present: Commissioners Johnson, McGinnis, Blockley, Stanley, Andrews Absent: Commissioners Tkac, Tragish 2. PLEDGE OF ALLEGIANCE: 3. PUBLIC STATEMENTS: No public statements. 4. CONSENT CALENDAR: 4.1 Non-Public Hearing Items 4.1a Approval of minutes for Regular Planning Commission meeting of August 21, 2008. 4.2 Public Hearing Items Will be discussed at Thursday’s meeting. 5. PUBLIC HEARINGS – GENERAL PLAN AMENDMENTS / Land Use and Circulation Element Amendments / Zone Changes 5.1a General Plan Amendment 07-1806 (Scott A. Underhill/Mark J. Smith) 5.1b Zone Change 07-1806 (Scott A. Underhill/Mark J. Smith) Staff report given, Commissioner Andrews asked that the site be pointed out relative to the Sports Center Development. Staff indicated that it is at least a half mile, or one mile, to the west of that. Staff indicated that it is two miles to Buena Vista Road from Stine. Ms. Shaw pointed out that it is between Ashe and Gosford. Commissioner Blockley inquired as to the memos received, to which Staff responded that all of the memos from Planning are informational and the May 2, 2008 memo from Public Works is the only one that changes content. Commissioner McGinnis inquired if it will be a right in and right out. Staff responded that if they put a full auxillary lane the entire frontage, with CalTrans approval only, they can have a right turn in and a right turn out. Commissioner McGinnis inquired what the access is to the east. Staff responded that on Stine Road there are no restrictions beyond the typical, plus the south line will have a local street that intersects Stine Road. Therefore, there will be some right turn onto Taft, with full left and right on Stine, with an actual street line that’s a south line. Commissioner McGinnis inquired if it would be signaled? Staff responded that it is not a collector so they do not know if it will be signalized. Staff also pointed out that this can be addressed during the PCD review. Commissioner Johnson referenced to the “out parcel” in the northeast corner and inquired if it was a right-of-way designation. Staff responded in the affirmative. 5.2a General Plan Amendment 08-1036 (Jim Marino, Marino & Associates) 5.2b Zone Change 08-1036 (Jim Marino, Marino & Associates) Pre-Meeting Minutes of Planning Commission–September 15, 2008 Page 2 Staff report given, Commissioner Johnson inquired if they are doing this prior to the CUP being approved at the county, to which Staff responded in the affirmative. Commissioner Johnson inquired if this is putting the cart before the horse, to which Staff responded that they do not care if they do the church in the County, as it will be zoned for church and houses. 5.3a General Plan Amendment 08-1168 (Cannon Associates, Todd Smith) 5.3b Zone Change 08-1168 (Cannon Associates, Todd Smith) Staff report given. Commissioner McGinnis inquired where this project is in relation to the proposed Highway 178 alignment. Staff responded that it isn’t on this map and therefore won’t be anywhere within the vicinity of what the Planning Commission is looking at right now. 5.4 General Plan Amendment 08-1033 (City of Bakersfield) located Metro-Wide. (Notice of Exemption on file) Staff report given. No Commissioner comments. 5.5General Plan Amendment 08-1128 (Summit Engineering, Maurice Etchechury) Staff report given. Commissioner Johnson inquired if they see a problem with the long term circulation of Allen Road and not matching up. Staff responded there was no road to the north in that location, but rather just a T. 5.6 General Plan Amendment 08-1045 (City of Bakersfield) Staff report given. No Commissioner comments. 5.7 Zone Change 08-1044 (Troy & Wilma Chastain, Trustees of Kern Co. Builders Money Purchase Plan) Staff report given. Commissioner McGinnis inquired if this was discussed last year, to which Staff responded that on Belle Terrace to the east there was something, but not in this specific area. Commissioner McGinnis inquired if the parcel to the east was annexed into the City, to which Staff responded in the affirmative. Commissioner Blockley also inquired about previous opposition from the neighbors to the north about an intensified development along Belle Terrace and a concern that it would be a detriment to the neighborhood. Staff responded that they will check on the history of this. Commissioner Andrews inquired if there has been any discussion with any of the other property owners in that section that cross-fenced their lots. Staff responded they have not had any discussions with the adjoining owners. Commissioner Johnson inquired if access will be off Fiorito Street, to which Staff responded they do not know. Commissioner Johnson inquired if it could be conditioned to limit access to just Fiorito Street, to which Staff responded it could because it is a GPA, however Belle Terrace is a collector and not an arterial, and therefore, you can have a lot of accesses onto collector streets, which in some cases actually helps with circulation. Staff also pointed out that because it is a duplex it may end up with both access off of the street on the west side. Commissioner Johnson expressed that he doesn’t think that access off Belle Terrace would be the safest option for this particular piece. Commissioner McGinnis again expressed his desire for some history of previous action on this piece. Commissioner Johnson inquired if the caboose is still further east, to which staff said no.
