OF BM(ERSFIELD, as follows: ~!VHEREAS the City of Bakersfield, a municipal corporation, desired to secure the right to construct and maintain a highway, upon and across the riEht of way of the Southern Pacific Compmay's Asphalto Branch~ AND ~[HEREAS Walker D. Hines, Director General of Railroads, Southern Pacific Pailroad, Southern Pacific Railroad, Company, a cor- poration and Southern Pacific Company, a corporation, are, mad each of them is, ready and wiltirkE to grant mmto the said. City the said right to construct and maintain a high~;ay, ~pon and. across said Southern Pacific Company's Asphalto Branch right of way; AND V~HE. REAS the Council of said City of Bakersfield is willlaCe to accept and the said Walker D. NOW, THEREFORE The Cotmcil of the City of Bakers field does hereby resolve that the said grmat be rand the s~ne is hereby accept- ed, subject to all conditions therein set forth, ~d that the ~l~ayor of the City of Bakersfield, be and he is hereby authorized to execute~ on behalf of the City of Bakersfield, that certain Indenture dated July 21st, t919, wherein ~!Valker D. Hines, Director General of Rail- roads, Southern Pacific Railroad, is the first party, the City of Bakersfield, a m~micipal cor~oration is the second party and the Southern Pacific Railroad Company and Southern Pacific Comps~y, corporations, are third parties and whereby the said Walker D. Hines, Di~ector G~neral of ~ilroads, So~ther Pacific Railroad, Southern Pacific Railroad Company s~d Southern Pacific Company cor~oorations grant to the said~ City of Bakersfield, a m~micipat corporation, the right to constr~ct and maintain a highway ~pon snd across the here- i~a~ove described land subject to the c6nditions therein set forth. I HEREBY CERTI~that the foregoing Resolution was passed anti adopted by the Council of the City of Bakersfield on the 21st day of July, 1919, by the following vote: Ayes- Baughman, Gilchris~, Itinman, Hougham, Renfro, Willow, Wilson.
