HomeMy WebLinkAboutRES NO 127-60RESOLUTION NO~ 127-60 A RESOLUTION OF .THE CITY OP BAKERSPIELD CALLING A SPECIAL ELECTION TO BE HELD ON THE 7th DAY OP MARCH, 1961, PERTAINING TO THE ANNEXATION OF BRITE NO. 2 TO THE CITY OP BAKERSPIBLD, TABLISHING VOTING PRECINCT, POLLING PLACE AND OFFICERS OP ELECTION POR SAID ELECTION, AND PRESCRIBING FEES TO BE PAID TO SAID OFPICERS OF ELECTION AND FOR SAID POLLING PLACE. WHEREAS, a written petition was filed with the Council Of the City of Bakersfie!d, requesting that certain inhabited territory therein described be annexed to the City of Bakersfield, and WHEREAS, by Resolution No. 116-60, the'Council of the City of Bakersfield. declared its intention to call a special election in certain inhabited'territory contiguous to said City proposed robe annexed 'to said city, for the purpose of submitting'to.the qualified electors residing in said territory the question whether. or not said territory shall be annexed to. said city, and setting forth a time and place of hearing protests against said proposed election, and WHEREAS, a copy of said resolution was published as required by law; and WHEREAS, prior to and at the time set for hearing protests. the proposed election written protests were not made by owners of one-half-of the value of the territory proposed to be.annexed, as shovm by the last equalized assessment roll and no protest was made .by public and private owners equal to one-half of the value of said territory, and · "WHEREAS, all proceedings have been had in accordance with said resolution and the Annexation'Act of 1913, reference thereto hereby being made for further particulars. ............. NO W~- THEREPORE, BE ~T':R~SOLVBD by'-~he -Council of the- City -of Bakersfield, as follows: . SECTION 1. A special election is hereby called to be held on the 7th day of March, 1961, in the territory hereinafterdescribed and proposed to beannexed to the City.of Bakersfield, for the purpose of submitting to the qualified .electors residing in said territory the question whether or not' said territory shall be annexed to the City. of Bakers- field and the. property in the territory .to be annexed be Sub3ected to taxation after annexation equally with the property within the City of Bakersfield, to pay the bonded indebtedness of the City of Bakers- field outstanding for the acquisition, construction or completion of municipal improvements. SECTION 2. Tha~-'said territory is hereby designated and identified for such election purposes and for use upon the ballots at such election' as "BRITE NO. 2". and is described as follows: , A parcel of land Situate in the County of Kern, State of California, and being a portion of Section 31, Township 29 South, Range 28 East,. M. D. Mo, also a portion of Section 6, Township 30 South, Range 28 East,.M.~ D. M., ~lso a porti'on of Section 1, Township 30 South, Range 27 East,'M~. D. M.,.and also a portion of Section 36, Township 29 South, Range 27 East, M. D. M.; Beginning at 'the northeast corner of'Lot 17, in said Section 1, said point of beginning also being the intersection of the southerly line of Terrace Way, of 60 feet in width, andthe westerly line of South "H" Street,' also known aS Kern Island Road, of 60 feet in width, and as said lot corner is shown on the "Kern County Sales Map No. 1 · . "filed for record May 3, 1889, in the of Lands of J B,Haggin, office of the County Recorder of said Kern County, a point on the current corporate boundary of the City of Bakersfield; thence easterly along the easterly prolongation of the northerly boundary.of said Lot 17, 6n.and. along said corporate boundary, and as same is defined by tha~ Annexation designated as the "El Camino District", as annexed by a Special Election held June 13, 1950, and which was approved June 19, 1950, by 'Ordinance No. 876, New Series, to intersect a line parallel with~ distant 30 feet easterly as measured perpendi- cular to the westerly boundary of said Section 6; thence northerly along last named parallel line, and along the corporate boundary of the City of Bakersfield, as same is defined by that Annexation designated as Terrace Gardens, as.adopted January 3, 1950, by Ordinance No. 857, New Series, to intersect the northerly line of Terrace Way, and as said Terrace Way' is shown on the map of the Virginia Tract, recorded in Book 3 of Maps, at page 70, in the office of the said COUD, ty ReCorder; (the last above described , intersection *and thelast.a-bOre-named-cour, se:are-desd~ibed by said'- Ordinance No. 857, New Series, as quote, "Beginning at the point of intersection of the northerly-lineof Terrace Way with the westerly boundary line of the Virginia Tract as said. E.)corner of Lot 1, in said TRACT NO. 1075, a point in the westerly line of Kern Island Road, of 60 feet in width, also known as South "H" Street; thence southerly along s~id westerly line of South "H, Street, parallel with~ and distan~ 30 £eet Westerly, las measured perpendicular to the easterly boundary of sai'd Section 1 to the northeast corner of the aforesaid Lot'17 the point of beginning, containing 42.444 acres of'land more 'or less. SBCTION 3. The polls at said election shall be opened at 7 o'clock A. M. of the day herein fixed for the holding of said election and shall be kept open until 7 o'clock P. M., of the same day, when the polls shall be closed. SBCTiON 4. Upon the ballots to be used.at said election there shall be 'printed the words: SHALL "BRITB NO. 2" BE ANNBXED TO THE CITY OF BAKERSFYBLD AND THB PROPERTY IN SUCH TERRITORY BE, AFTBR SUCH ANNEXA- TION, SUBJECTED TO TAXATION EQUALLY WITH THE PROPBRTY WITHIN THE CITY OF BAKERSFIELD, TO PAY THE BONDED INDEBT- EDNESS OF THE CITY OF BAKERSFIELD OUTSTANDING FOR THE ACQUISITION, CONSTRUCTION OR COMPLETION OF MUNICIPAL IMPROVeMeNTS? OppOsite these 'words there shall be printed the words "Yes" · and."No "' and to the right of each' of these last two words there , shall be a voting square. If an elector shall stamp a cross(+) in the voting square after the printed word "Yes" the.vote of such elector shall be counted in favor of the annexation of said territory to the City of Bakersfield; and if an elector shallstamp a cross (+) in the voting square after the printed word "No" the vote of such elector shall be counted against such annexation. In all particulars not herein recited said election shall be held in conformity, as near as may be, with the laws. of the State of California concerning general elections a'nd with said Annexation 'Act of 1913. SECTION 5. (a) For the purpose of said election there is hereby established in the territory proposed to be annexed, one (1) voting precinct con- sisting of a portion of Precinct'Bakersfield North and a portion of Precinct Bakersfield. South, which shall include all of said :territory. The following isthe polling place of said election precinct and the following named persons are hereby named officers of election and shall constitute the board of election for such election precinct': POLLING PLACE: William G. Bowen (b) For their services in connection with said election, said Inspector shall receive $21.00 and said Judges shall receive $!8.00 each; and the person-in possession of the polling place named herein 'shall receive for the use'of such premises in connection with said' election the sum of $18.00. SECTION 6.
