HomeMy WebLinkAboutRES NO 114-60RESOLUTION NO. ]~14-60 RESOLUTION OP THE COUNCIL OF' THE CITY OP BAK_BRSPIELD, ORDERING THE VACATION OF A PORTION OP HOUSBR STREET IN THE CITY BAKERSFIELD. WHEREAS, on the 17th day of October, 1960, the Council of the Cityo£ Bakersfield, pursuant to the provisions of the "Street Vaca- tion Act of 1941," being Division 9,'Part 3, of the St'reets and High- ways Code of the State of California, passed and adopted'its Resolu- tion of Intention No. 756, declaring its intention to order'the vacation of a portion of Houser Street, City.of Bakersfield, California, and WHEREAS, said Council did fix a time and. place.for'hearing all per. sons in.teres'ted in or objecting to said proposed vacation,.which said hearing was held on the 7th day of November, 1960, after notices were duly posted as required by law,.. and ~HBREAS-, this Council after duI.y considering the matter, does hereby find and resolve as follows: ' 1. That 'that portion of Houser Street, situate in the City of Bakersfield, County of Kern, State of California, said. Houser Street being of 60 feet in width, situate in the City of Bakersfield, County of Kern, State of. California, as Sameis shown on the map of the "Sunset. Tract" filed for record July 6, 1910, in Book 2 of Maps, at page 5, in the office of the County Recorder of sai'd Kern County, more '7 particularly'described as follows, is unnecessary for present or prospective public street purposes: Beginning at the Southwest corner of Block E, a point on the northerly boundary line of said Houser Street;.thence southerly along the southerly prolongation of the westerly boundary.of said Block B to intersect thenorfherly boundary ~f' Block' D', a point' on ttre-soUtherty-~'boundary line of said- HouSer Street; thence easterlyalong last named southerly boundary line to intersect the northwesterly right-of-way line of the Sunset Western R. R.. (also known as the Asphalto Branch of the Southern Pacific Railroad); thence northeasterly along last named right-of-way line to intersect the southerly boundary Of said Block E, a point on the northerly boundary .line of said Houser Street; thence westerly along last named northerly boundary line of said Houser Street to the. Southwest corner of said Block E, the point of beginning, and as said Street, Blocks and Railroad. right-of-way line are shown on said map of the "Sunset Tract", retaining the westerly 25 feet of the southerly 6 feet of the above described parcel of land for the purpose of a public utilities easement. 2. That said portion of Houser Street be and the same is hereby closed up, vacated and abandonedfor public street purposes, subject to and in conformity with the reservations and exceptions contained in and contemplated by said Resolution of Intention No. 756. Reference to said Resolution of Intention is hereby made for further particulars. 3. The City Clerk shall certify to the passage of this Reso- lution and shallcause a certified copy hereof, attested by the Clerk under the.seal of the City, to be recorded in the office of the County Recorder of the County of Kern, California. -o0o I HEREBY CERTIPY that the foregoing Resolution was passed and adopted by the Council of the City of Bakersfield, at a regular meeting thereof, held on the 7th day of November, 1960, by the following vote: AYES: BP, LFANZ, BENTLEY, CARNAKIS, COLLINS, CROES, DOOLIN, STERN, NOES:~ ...................
